Car hire in germany - Winter tyres

Its German Law that states from 1st of December that cars have to be fitted with Winter tyres to comply with driving conditions
so why are hire companies charging extra for winter tyres? surely they're breaking the law by providing cars without winter tyres (for those that dont take the option)

I rented cars twice in Germany in October time... twice it had winter tyres on, and no extra charge for them.
its one of those things where if you ask for a econ car and get one with winter tyres fitted they wont charge you extra. if you request them specifically they'll charge you.
