Sounds like Felipe is fighting a losing battle... & strange to think that quite a few of the cast are still involved in F1.

It's not so much that we all lose. It's a couple of things. The first is that anyone with any knowledge of F1 knows that no race in history has been annulled because of a single team cheating.He had a great year while Kimi R was a bit a nonny mouse in the sister car.
We all recognise that it's a stupid, frivolous case, and anyone being objective also sees that it pales next to the daylight robbery of AD21 - so you'd have to review every single controversy in F1 and re-write the history books if you accept his arguments.
The second is the dignity he showed in Brazil in 2008 - that earned him a lot of respect and goodwill among fans. And now rather than coming across as a graceful loser, he comes across as being a rather bitter individual.
Why on earth would he deserve compensation?
A millionaire suing a billionaire and and a $multi-billion corporation over something which happened in a sporting event 17 years ago. The case is completely ridiculous, Massa is being very badly advised and the lawyers will be the only winners. Trebles all round, as Private Eye would say.

It is a strike out application by the defence, ie they say Massa's case is so legally weak it is bound to fail without having to examine the evidence in any detail at trial. Confident enough to ask the judge to end it now.
Problem for Massa will be the causation test. Onus is on Massa to prove on balance of probabilities that he would have won the championship BUT FOR the cheating.
In the Singapore crashgate race, Massa wasn't taken out or lost position following the crash. He pitted in the lead and could have contined his race. His dnf was caused by driving from the pits with the fuel hose attached. How can that incident be attributed to Briatore et al who had triggered the pit stop cycle by the Piquet crash? Alternatively, he has to show that FIA would have been obliged to annul the race ex post facto, and not adopt any of the possible alternatives such as let the result stand and dsq Beneton.
I suspect this will be the end of Massa's rather fanciful claim.
