warrenty on a car?

any one throw any light on what seems to be a grey area seen a car on fleabay nothing great mg sports being sold by a motor dealers ad says taken in part ex and has some issues and sold without any warrenty? thought any dealer had to sell a car with some form of warrenty ? I asked the question and was told how can we give a car a warrenty if it has faults and warrenties only kick in at a certain price ??? can any one tell me more many thanks

A trader has certain legal obligations. So not strictly a warranty, but the vehicle has to be fit for purpose.However, buying from an auction like the BCA makes this somewhat different, so I don't know how an online auction like ebay differs or not.

The dealer can say what he likes, he's still got legal obligations.Unless he's selling it as scrap?

If I sell a car through BCA or similar auction Im in no way liable to its condition, if it is clear in the auction write up on ebay that the vehicle is totally as seen/no warranty, do not bid if you do not agree to these terms, I do not see why it shouldnt have the same rules as BCA and the like.
However it probably isnt the case.
I would think that the dealer could provide a warranty which excluded the pre-existing problems that he lists on the auction? Depends on the scale and detail he's provided on the issues, but I wouldn't touch it with a bargepole, he probably gave absolute peanuts for it and is looking to shift it on at a quick profit to some naive (hopefully far away!) fleabayer without having to do anything to it.

Not always the case though is it??We might take in a car in the 1K-2K bracket that looks ok, drives ok, but we sell cars in the 5K-20K bracket so wouldnt retail from our showroom....ebay should be an ideal disposal tool for such a car at a few quid over what it would do in a traditional car auction, however we dont bother because of possible SOGA hassles, possibly several months down the line....lose/lose situation really, the only winner is BCA and the like.
I think the problem here is that you've seen that the car is at a dealers and imagine he's bound by some warranty on the car, because he's a dealer. Sounds like he's being completely honest and open, and pointing out that the car is flawed, has problems, which he's not prepared to cover, and as such is saying, "take it off my hands, sold as seen, problems disclosed, no comback", offered without warranty. If that's not acceptable, walk on I say.

I think the problem here is that consumer law prohibits them from doing so......(although some degree of problems should be expected with used goods etc and it's a bloody minefield)
THey also mentioned that warrenty obligations only kick in at a certain price. ? but they didnt mention what that price was!!! they just said thats a fact and look it up if I wanted.. any views on this one
the car was only around 500 so not a great issue.. wont be going for the car but it started me thinking .. hense the posting
Yeah, giving it a bit more thought, I guess the seller would avoid all this hassle by selling the car outwith his dealership, if it has known faults, give a receipt showing sold as seen, just like we all do. Because he's decided to sell under his dealer name, presumably wanting his ebay star, he'll not be able to avoid any statutary rights the buyer has.
