Had a guy look at my car last week, sale agreed etc no problems
Phoned him as agreed this afternoon at 4pm, ' yes i will be up in the morning with a bankers draft etc
we had a good chat about cars in general, all was fine
Told him i had my cherished transfer back etc blah blah
Told him i was going to look at 2 cars this evening..
Said to the wife something wasnt right, even though he sounded 100% on the phone.

here comes the BUT
He phones 1 hour later to say he has found another car.
To say im gutted is an understatement.

Morale of the story, car is never sold until money change hands

In the past had many callers who didn't amount to anything. Never someone who has agreed a deal though, that is poor show. I think that is why most would use some form of a deposit - to officially take the car off the market - even if the full amount hasn't changed hands. If the buyer is serious, they'll only be too happy to secure the car and if not then you'll know.

I always take a good sized deposit (at least £200 or 10% of the value of the car) for the car to both cover my own costs (the ad, re-advertising it plus the private plate transfer fee) and to deter the buyer from 'walking away' from the deal.

If they are a serious buyer they won't hesitate to agree.

I don't sell many cars, but as said above, even if people beg and plead for you to hold the car, it goes to the first buyer who stumps up the readies, regardless. If someone wants to leave a deposit, it is with the strict understanding it is non refundable, and limited to 14 days to complete the sale unless otherwise agreed.

Works the other way too though!

Agreed a deal on a car on PH that I offered asking price on, and made arrangements for a flight to go and get it, (was a few hundred miles away). Called with a week to go and was told seller (who'd been selling it for 8 months, dropping the price every other month) had deceided to keep it. Missed out bidding on at least 2 others in time since dela was agreed.

weird thing is, 2 days after he told me he was keeping it, it was back on PH for a grand more than his previous asking price which i was paying in full(the agreed sales price!)

A month later, still for sale, then advert expired...


When it comes to buying and selling cars, it seems accepted that agreements can be broken left right and centre, whereas, legally, a verbal agreement on price and deal constitues a proper enforceable contract!

A post from me detailing a similarly frustrating experience.

I had recently taken a deposit for my RX-8, and the guy text me three days later saying the remaining funds had been transferred which I was very happy about as I've not been able to sell this car for months. Anyway, another chap called me that same day (like buses etc) saying he was staying at a hotel in Gatwick and was very interested in my car, but I told him it was sold. He was quite insistent on at least viewing it and if all was well would pay more than the offer I had already received.

Although, the money had not reached my account I still told the guy it was sold and it'd be incredibly harsh to sell it to him rather than the guy who had left the deposit. He begrudgingly agreed, but I told him I'd keep his number just in case.

A week later it was clear that the original guy was lying about transferring the rest of the money and had no intention of completing the deal as he was avoiding me, and when I rang from an unknown number he heard my voice, hung up and switched off his phone. The other chap had already bought another RX-8 and seemed to take great delight at my misfortune when I rang him to see if he was still interested.

The worst thing is that he and his partner were such lovely people, and I was really glad the car would be going to a good home. I also bought the moron 6 months road tax, had it professionally valeted, sorted out a few minor issues and took a day off work for him (contractor, I don't get paid holiday). I also transferred over my insurance to my new car so the car is now stuck at my parents until I get it re-insured.

Yea real piss take. I already had another car lined up that i was getting excited about and was getting a great deal on it. Number plate off my car all ready to go.
I though something was up when it was me phoneing him and not him phoneing me asking about any updates and when the car was ready to collect.
Worst thing was i call him at 4.00pm today and he was comming tomorrow morning to collect it, saying to me that i wouldnt waste your time getting you to do a cherished transfer etc etc, i dont do those things....
then 1 HOUR LATER he's not takeing the car.
Feck off!

Could be worse, you could have sold a car in good faith and taken a cheque as payment as you trusted them... only for them to do some checks AFTER taking the car which they should have done BEFORE agreeing to buy... and then be advised by some idiots on a forum to cancel the cheque and return the car.

If this was you and you want your money then I can help you...... You can issue a court claim for the value of the cheque which will succeed (and it's not often a person can tell you that)......

I did once agree to buy a car on impulse but decided after sleeping on it that it wasn't really the one I wanted, so at least had the decency to phone the bloke back at 8.00am the following morning to tell him and apologise profusely. I did feel bad but tried to mess him about as little as possible.

Thanks for the concern but no, it's not me. I'm just having a dig at some of the stupid advice that was dispensed to a buyer on another part of this forum.

I know I get bent over for it but this is why I part exchange my cars at a garage.

I've only sold one car and it turned out to be a massive ball ache.

Thats where i will end up also, tradeing in that is.
Just hate getting at least 1k less than the car is actually worth and then also giving the dealer
2-3k more that i can buy the exact same car for privately.
Ever see a car dealer living in a small house, not where i live anyway....
