Dealer Didnt Settle Finance
Discussion
Hi, I'm sure this has happened more than often, Since the dealerships got nothing to lose! Finance was accepted! Money was sent by Santander to Dealership! Next Day Deal fell through. Dealer didn't want the px!?! i told him you should have said that before i signed the papers...Anyway he calls his Finance Company to confirm cancellation. Santander Fax the Dealer to settle the amount in 10 days! Dealer says i have to pay a charge? What for? Cancellation Charge?!? anyway he takes £190 odd. i walk out Furious.....
A Month Later Santander Takes the first payment DD £190 odd??? I call them, They say Dealer has not settled the payment? i call dealer, Dealer say they have (Liars). after a week of running like a headless Chicken, Santander says they have been contacted By the Dealer who have issued a Cheque...Downside is of the revised amount which is £190 odd less.
Santander says we cannot refund anything! they have received £190+ rest from dealer= full amount. Dealer (Frauds) have kept £190 initially as a charge and another £190 from the Finance money...What do i do Guys?

The first thing to ascertain is who is in breach of contract.
Did the dealer originally agree to take the p/x and then change their mind after the finance was approved? If so, do you have any proof of that?
Assuming they did then you would have a claim against them for the £380. You should first write to them giving them the basis of your claim and 7 days to pay up. If they dont, file a county court claim agains them via the moneyclaim web site.

But seriously it stinks for you. I've got a brake fluid visit well over due for a bad deed done to me but decency prevents me from doing it.

If an error is made in the payment of a Direct Debit, then you are entitled to a full and imediate refund from your bank (i.e. the bank that runs the account that the Direct Debit was taken from).

t guys, it's up to the dealer to assess the px before doing the deal paperwork. God I hate it when PRess start to get all suspicious and judgemental.

You should know by now that there are a lot of budding Miss Marples sitting behind their keyboards solving all sorts of crimes and misdemeanors. Who needs evidence nowadays, guilty until proven innocent rules ok.
You might be happy to take the OP's version on face value, but IME there are two sides to every story and the obvious question is why did the dealer reject the part ex.Bill said:

So it doesn't occur to you that prior to concluding a deal, completely a credit check, and getting the customer to sign binding documents, he should check that he is happy with his commitment on price and allowance for px?How utterly ridiculous. You suggest that he can give a figure, without doing his due dliligence, then revise it when he can be bothered to look at the car? Patently stupid.
I am constantly amazed by how cavalier dealers are over px's, and I know they take in a lot of lemons that way. That is partly why px values offered often seem low, and why it's not always a great idea to buy a dealer px at auction. However, dealers are there to take it on the chin. They are in business, and it is up to them to make sure they are happy with a deal, before doing the paperwork, they can't change their mind after the deal is done. To suggest otherwise is insane.
An oft told cliche on this site is 'it isn't sold until money's changed hands' well it seems to have in this case, although with the finance it's a little more of a grey area.
OP REPORT THE BUGGERS TO TRADING STANDARDS, LEAVE REVIEWS ONLINE, AND SEND THEM A 7 DAY LETTER DEMANDING ALL £380 BACK, IF THEY DON'T PAY IT GO TO THE SMALL CLAIMS COURT.

Anyway I'd be surprised if a dealer, however dodgy he may be, would do something like this just to make £190 - would it really be worth the hassle?
To all the conspiracy theorists who smell a rat all the time, and just 'know' there's more to everything than meets the eye etc etc.
You natural suspicion says more about you than the person you are suspicious about!
There again maybe it's just me being stupid, because naturally all second hand car dealers are known to be white as the driven snow, and it would certainly be the first time ever that anybody in this much respected industry was suspected of any sort of 'sharp practice'!

And of course we all know most people come on pistonheads to get sympathy by making up a fairy tale, rather than admitting our guilt in deceiving one of these poor hard working honest car dealers, and getting ourselves into finance deals for a car we don't own.
That naughty OP probably told the poor salesman that his px had one careful elderly doctor lady titled owner who had only ever travelled on motorways and had the oil changed every other day and kept it in a feather bed! How was the poor salesman supposed to know otherwise, of course he would take the customers word for all of this and price the px at a premium accordingly!

Are you the OP? You seem to be getting very het up about a perfectly reasonable question.
No, is this another conspiracy theory?
It just winds me up a little that genuine PH'ers can post their experience on the forum, and half of the responses seem to be snarling criticisms saying that the OP is lying.
Nobody needs to lie on this site, nothing to be gained by making up a story to vent imaginary frustration!

Maybe I'm just naive, but I'd rather be that way than assume everybody's lying!
Just to take the heat out of this and be objective:
OP:
a) What reasons did the dealer/trader give for rejecting the trade in?
b) Had they inspected the trade in prior to agreeing a price?
c) Did they place any conditions on the trade in whilst finance was arranged?
d) Is it a trader, or a main "franchise"/"manufacturer" dealer
e) What do the finance t&c's that you signed mention in terms of arrangement fee or termination fees/admin fees?
