insurance policys with vandalism extras

hi I'm with esure for my insurance on my car. But was recently vandalised. My policy says they fix this and it does not affect your NCB. Any one had this on theirs and used it .

Don't quote me on this but doesn't the T+C's of vandal cover mean they have to secure a prosecution for it not to affect your NCB?,
