I'm amazed at how many traders selling cars on eBay try to con buyers out of their statutory rights.

A few examples I've spotted of wording in adverts, bear in mind these are traders:

1) "Part exchange to clear, therefore sold as seen without warranty"
2) "No warranty either express or implied"
3) "We don't provide a warranty but can arrange one through www.randomwarrantycompany.com"
4) "Trade/consumer sale so no warranty given"

AFAIK when buying from a dealer the car must be fit for purpose. If the car develops a fault in the first 6 months then it is deemed to be at present at time of sale. I know it's a very, very grey area & all cases are different but traders who put the above into their ads really piss me off.

One even wrote (even though there were no faults declared in the ad) "car will be sold on a spares or repairs basis, which means no warranty will be given whatsoever."

I suppose if the car was sold as spares or repairs, even if it was purchased from a dealer you wouln't really have a leg to stand on if it developed a fault?
Thoughts?

I know what you're trying to say with this - but whenever I see that wording I assume it's fked in some way and so price it accordingly in my head. Most people buy from a dealer for the peace of mind, by putting such a statement they're removing the sole reason to pay the premium, so I bet people don't.

It's nothing unusual. There are always those in business who will try to avoid their obligations.

Indeed t not unusal, a certain TVR dealer is doing it with a car right now on PH, I phoned and enquired why, the chap was very clear that it has issues.

I'm ok with it as long as the dealer makes clear what the issues are. Afterall, the car has to go somewhere.
