I'm in court on 28th September, taking a car dealer to court for mis-selling a car, and I need help/advice from someone in the Trade.
Without going into the whole story, I bought an ex-lease car, advertised with Full history, from a Used car Emporium. I bought the car on the assurance that the Service history was on it's way from the Lease company. The service history never arrived and I am arguing that a lack of service history a) should have been reflected in the price of the car, and b) the value of the car is going to be adversely affected when I come to sell it in a few years time.

So my question to you Guys is......

What is the value of an '06 Civic 2.2 iCTDI Sport, 94k miles WITH FSH, and the same car without service history.

Shouldn't your lawyer be finding stuff like this out for you?

It might give you an idea of price difference if you put details into We Buy AnyCar without service history and see what you get offered. Compare that with the price you paid. WBAC will probably offer bottom dollar, but it could serve as some sort of indicator.

Good luck.

What did you pay and what are you trying to achieve? Surely you must have an idea of the value gap to have an issue in the first place. When first raising the issue with the supplying dealer did you request a certain amount back?

I can't see it being more than 3-500 quid max on a 5 year old Civic with more miles than most punters would touch. The issue is that it will be harder to sell on when you have finished with it but that is difficult quantify the impact of that on you when nobody knows when you will sell or what the market for such a car will be like at that point.

Whilst I agree with your points aren't they one and the same..?? The fact is that a lack of service history devalues the car. More importantly though from what you've said your decision to purchase the vehicle was based on the fact that the car had a FSH and without one would you have proceeded with the purchase..??

Just playing devils advocate. Can you prove that the dealership mention the fsh? Or was it mentioned in an ad ?
Would hate for the situation to turn into your word against theirs

It's doubtful that a court would accept "I got these valuations from somebody on Pistonheads" as a valid source of evidence.

Would suggest that you contact an independent vehicle assessor who values cars on behalf of insurance companies, it will cost you a few pounds, but you should get it back if you win.

Try this lot, they do insurance valuations for a company I'm invovled with http://www.laird-assessors.com/
