new or old damage?

i'm sorry for the blury picture, but does this look like damage that happened a few minutes before the picture was taken, or does it look like old damage?

i'll explain why i'm asking when i've had a few answers

I am guessing it has been a while becasue it looks a bit dirty. O/T is it a Ford Focus?

I would wait till more people comment though.... smile

Gut feeling says old and it also says that that's exactly what you want to hear!
You need a better picture though.

Unless the panel was already rusty, I'd say it looks old(ish)

she reversed in to me while i was geting into my car, she immediatly moved her car before i could get a picture of the cars together

she started shouting that i had hit her, i had my wife and kids with me, so i have witnesses

she is claiming that the end section of my bumper caused the damage shown in my opening post

this is my car, the bumper is way too high to have caused that damage, and to me the damage looks old

Difficult to make out with the pic, but are the edges there sharp and/or sheared? More like the driver had hit a solid well defined post rather than being impacted by a curved (and I daresay deformable) bumper?

ETA: just noticed the damage on the higher part of the arch - that definitely looks old... and would need to be a glancing blow to do damgage over that height range without pushing the panel in futher?

I'd put money on that damage being from months ago an her thinking it's her lucky day!! The edges around the damaged paint look dirty an my guess is the driver has reversed over a small post or wall.

Yours is the Touran or the 4x4? I'd say it looks fresh because of the dirt on top of the plastic trim? If it's the 4x4 its probably the exhaust that she hit?

The correct question is "Can you identify the Blue car - make and manufacturer.. from the picture".

well this just gets better, i've had a letter today from some Ambiwlans chaser scum, not only does she now say i hit her, she also want's to claim for whiplash and loss of 4 days earnings due to injury, W.T.F. is this woman on?

how the heck would you get whiplash from an accident that caused that little bit of damage?

the only good thing i can say is that i have a great insurance company, instead of just giving in or asking me to go 50-50, they intend to fight her all the way

Ho could she claim you hit her if she reversed into you whilst you were getting into your car?
I assume your car wasn't running and therefore not moving at the time?

Well this is getting silly, this claim is still ongoing

An impartial body work man inspected both cars, he told the insurers that my car couldn't have caused the damage, but her insurers still won't admit that they are wrong and she is a scammer.

I have no idea what will happen next.

This is the vectra that they say i hit with my back bumper



And this is my back bumper, that is 21 inchs high, how can her insurers still be fighting this?

They're probably hoping you won't take it to court and cave in. Stick with it all the way, the court will take advice from an expert witness such as you mentioned as you had it inspected and 99% of people would see her damage isn't from what she accused you of doing.

Absolutely! OP can you clarify exactly what happened? were you driving at the time? She sounds like a broke fraudster and I would be inclined to report her to the police - its why our insurance premiums are so high!!!

In my (bad) experience your wife's witness statement will be of no use.

Has the lady in the other car got a witness?
