Hi Chaps

I took Monday off to enjoy the last of the Indian summer and the wife and me drove out to Westerham from where we live in Petts Wood for lunch.

On the way back when driving through the lanes I drove over a pothole. It went bang through the whole car, it really was quite a bump. Anyway, I didn't think anything more of it until i go home from work last night and noticed the Maserati had a flat rear nearside tyre.

On closer inspection the rim is dented and the tyre isn't sealing with it properly and hence the flat.

Obviously I don't want to swallow this as I think I pay enough tax and road fund licence to drive on roads that won't smash my car's wheels to pieces so how do i go about getting this resolved?

Has anyone any previous experience of claiming against councils for poorly maintained roads?

i havent actually claimed for alloys but i had a case that i could have done, i was advised to take a picture of the pot hole before the council fill it in and take a picture of the wheel as proof of whats happened then report it to the council that this is whats happened.

I have heard that several people have had success with getting repairs and new wheels/tyres.
Contact the council, tell them what happened.
If possible include pictures of the pothole, the wheel, the time of day, the exact location of the pothole and everything else you can think of.
Keep copies (obviously).

This happened to me many years ago. Took a picture of the damage to the wheel and the pothole and sent these off to the council who reimburesed me for the replacement wheel. It's definately worth persuing.

It's very easy to do - just speak to the council. You want the highways dept, they will have paperwork packs etc ready to send out to you - they budget for third party claims. smile

While you are at it, REPORT THE POTHOLE to the maintenance department. Too many people moan about the state of the roads, although don't report it, yet expect the council workers to be psychic and know where every pothole is as soon as it appears. teacher

Dont councils have a "get out" clause in regards to compensation i.e. If they arent aware/pot hole hasnt been reported then they arent required to pay up?

It is definitely worth pursuing. A chap I work with bent an 18" wheel by driving over a pothole to the extent that the tyre deflated immediately. He took some pictures whilst he put the spare on and got in touch with the council, who sent out the claims forms and paid out pretty quickly.

Every single time? I'm sure I've read either on here or another forum, that they dont always pay?

It's not something I've ever heard of (I'm a highways maintenance engineer, we get loads of these through) - there will always be cases that aren't covered, say if the "pothole" turns out to be a scrape in the road that couldn't possibly cause the damage. But generally, if it's a valid claim, it gets paid. And even if it doesn't, just speak to your local councillor, they will say one word to the highways dept, and the payment will be forthcoming.

800 pounds for a new wheel and none currently available 2nd hand.

I've had another look at the wheel and from what I can see it's a small dent in the edge of the rim that is causing the problem, I wonder if a wheel refurb guy could do something with it?

I haven't contacted the council yet.

Can anyone recommend a wheel refurb guy near me in Orpington please? They're all a little bit scruffy so I'll probably get them all tidied up at the same time.
