In the old days you got your excess back after the car was repaired if the accident wasn't your fault.

Does this still happen, or have all the insurance companies decided not to bother arguing about fault in accidents?

Sometimes it's cheaper to accept partial liability rather than go to court and argue the toss.

So you do get your excess back if the other party admits liability?

In cases where someone runs into the back of you is it still the law that they are always at fault?

Doh
You should only lose your excess if a claim is being made on your policy
It's for when an accident is your fault

If the insurer is able to claim back all losses then yes you should get your excess back.
I don't think it's ever been "law" that the party who goes into the back of the other party is at fault, it usually is the case that they are liable however there have been cases where liability has been shared.

It's for when an accident is your fault
Not so. The claim might not be your fault but if for whatever reason you can't hold someone else responsible then you won't get your excess back. If you get hit whilst parked by an unknown car. Or the third party lies about the circumstances and there's no independent evidence.

But if there is another party to hold responsible and they or their insurers accept liability, then you can recover your excess.
