My 330d touring e91 was reversed into last week so is going in for some cosmetic repairs.
A replacement vehicle has been organised by Drive assist - awesome customer service! Unfortunately the car i was expecting (mondeo, astra, 1.0) never turned up.
Instead a brand new 525d M Sport touring with only 50 miles on the clock showed up today with all the toys. The issue is that when i brought the 3 series i knew i should have got the 5 series (bigger, more toys etc)
After a drive into work today i have already found my self online looking at 5 series - DOH

Reading this i first thought you were being sarcastic, but you're actually being serious aren't you?!They were on Watchdog a few years ago for trying to scam thousands of people (myself included, fortunately i'm not that stupid) by charging for damage to hire vehicles that never happened! Avoid at all costs!!!
And look at the hire cost and small print.
If they can't recover the hire cost from the insurer, you are on the hook.
A couple of months ago I had a similar situation. Golf 1.6 manual in the shop for repairs - replaced with brand new 3 series coupe complete with red leather interior at £60-odd per day plus VAT hire.
I complained to my broker - no wonder insurance costs are through the roof when this sort of thing goes on.
If I remember rightly, the Watchdog thing was also about a few insurers saying that £x was a reasonable amount for hire and then DA going after the individual for the difference.
I hope you went over the car with a fine tooth comb on the hand over. Although I had no come back, they did note when I returned the car that it had not been washed. It had been washed the night before and stood on the drive. In contrast, they stated that the car was clean following a 50 mile drive to deliver to me.

Car only has 50 miles on the clock, still checked it over and car is obviously immaculate.
Other party has admitted liability, so all ok on that front... even have a voice mail from their insurance company stating that he was at fault.
For now I'm gonna enjoy it

The other guy's insurer may need to and agree to put you in the position that you would have been in had the accident not happened. That position was not swanning around in a brand new 5 series on credit hire.
Have you got a credit card? Could you afford to hire a car and pay for it yourself if you were to be reimbursed? Are the credit hire costs of the 5 series reasonable and enforceable? Would the body shop you chose have given you a free courtesy car?
If the other guy's insurers have put you in the 5 series then just enjoy it (but don't moan about the cost of car insurance in the future). I was once given a delivery mileage Volvo S80 for a couple of weeks when my 10 year old E39 5 series took a hit when parked but I didn't and wouldn't credit hire it.
Be careful and double check that paperwork. If you know which insurance company is paying the bill, I would seriously give them a call.

What annoyed me was that while my policy entitled me to a replacement car, as the third party admitted responsibly up front my insurance company simply passed the entire claim to a claims management agency. I should have paid closer attention to the fact they passed the case on and had I checked what the cost was going to be, even though I wasn't liable for it, I've have taken the bus for a week.
Another word of warning, when the final repair and hire costs were billed to them, the third party's insurance company decided to deny the claim on the basis of the hire car costs. It was all sorted out in my favour but it took almost a year and was settled just days before the court case was due to be heard.
Finally, even though I was miles from my car when it was hit - it was parked, I was at work - I received calls from injury lawyers for months after, so you may have that to look forward.
Still, nice hire car!

It's not about who's liability, you need to be seen to be acting appropriately re: costs, and running up a huge bill on a better car is not, therefore you will end up footing the bill.
Thread title seems appropriate though!

Check into it OP, but I would suggest that it is more likely you wont have to pay rather than a dead cert that you will...Lot's of doom and gloom merchants on here just waiting to put the fear of god into people. TBH a 5 series Touring isn't that big a jump from a 3 series touring is it? If they had turned up in a 7 series or S-Class i could imagine it might be more difficult to justify.

In my case I didn't have to pay anything -- apart from increased premiums because someone hit my car -- but the cost of the hire car was the reason the claim dragged on for almost a year. While there may not be much difference in cost between an 'average' car like a Mondeo and a 3 series --or even a 5 series -- there can be a significant difference in hire costs, and that's what makes the difference.
