Coming back from work I got myself into a 'situation' with a taxi driver.

Picture discription: me in green, I am turning left onto the main road (not down to the left again) waiting for the white car to pass. I notice the taxi (red) indicating right but he was still a good 20m away. As white passes I pull out as route clear. As I enter road taxi continues and starts to turn which forces me to 'take evasive action'. Taxi driver rolls down window and begins the tirade of abuse which I didnt take well.

Safe to say we didnt discuss who had right of way as I was explaining to him that I was a powerfully build Director of Red Bull or whatever and that my Scottish accent didnt mean I was a tosser etc.

Was I in the wrong or was he?

I think whoever left the huge Tampon in the road was in the wrong.

I'd say he should be giving way to oncoming traffic, yourself included. Regardless of the fact you are pulling out of the junction.

You have given way to your right, it's clear for you to proceed. He should give away to all oncoming traffic.

I would say that if you had left the junction you were at before the Taxi was in a possition to turn right, then its his fault. if all the taxi driver was waiting for before he could turn right, was the white car to pass, and you were still waititng at your junction, then its your fault.

As for the Scotish accent though..............

Even at 10mph he would cover that 20m distance in just 4 or 5 seconds.

He is on the main road and signalling his intention to turn right, so you should have given way to him.

Take 3 Red Bulls and call me in the morning if it hasn't improved.

Wouldn't you be more worried about the huge blood red one?

That junction looks very much like one I use every day. My route, and my attitude to people emerging onto the road, is exactly the same as taxi man's. There is a give way line for people joining the road, which I am already on.
I may be wrong though. I certainly wouldn't be shouting abuse.
I very nearly started a simular thread but couldn't be bothered to draw a fancy diagram.
P.S. is that Junction in Ashtead, Surrey?

With hindsight it looks to me like a 50/50 situation. I had fully emerged on to the road before the taxi had reached his turn but due to how close his turnoff was to my junction that is where I get confused. Still dont think I deserved his rant though...2 red bulls down 1 to go wink

Probably, doubt if there is another one like that in the UK.

I'd say technically, his fault. He turned across your path and by that point you're already on the main road.

Practically, you both made mistakes and if either of you had driven a little more defensively it wouldn't have happened. Insurance would probably go 50/50, I'd imagine.

I think you need to ignore the bend in the main road for a better judgement. You emerged from his right and turned towards him, so technically you had the right of way...
