I say old bean, I had an unfortunate event of the gearbox becoming faulty in my E39.

I had the gearbox overhauled which included the torque converter and all the other smashing bits and bobs.

However, sadly approximately 3 months later the gearbox appears to be slipping, shuddering and not feeling very well.

The gearbox warranty happens to only cover the actualy box itself, not the labour between taking it off and putting it back on. I was very surprised to be told this and thought how rather odd.

Am I being unreasonable to be expecting this repair to be done with no cost to me. After all, it has only been on there for a mere 3 months!

I would have thought the warranty covers 'work done'. Which should include the lot IMO.

Should also point out its a well established ltd company, no dodgy cash in hand type thing going.

Did you just supply the gearbox to be rebuilt or did you supply the gearbox on the car.

If it's the former I would expect them to act as they are however if they originally removed and refitted the gearbox before and after rebuild then I would expect that to also be covered by the warranty.

I gave them a car with a broken gearbox, they gave me back a car with a working gearbox.

I paid the bill at the end.

Then you're not being unreasonable asking them to fix it under warranty.

How much did you pay for the work?

How much are they going to charge you for doing it again?

  • Almost certainly this is a a situation wher epaying a few ££ to a solicitor will get things properly sorted for you. I'd be looking for them to cover both parts and labour.

I all can give you some sound ful advise if you are willing to accept it.

Firstly when you go to a reputable company and have work done you automatically have certain unofficial backing in terms of the law.

Firstly you gave your car un full faith the work to be carried out was to be a full overhaul to the gearbox. What does an overhaul of the gearbox mean. It means in no uncertain terms that you essentially have a refurbished as new gearbox. This indicates the gearbox should last at least another 100k miles clearly this isn't the case. It is unreasonable for a company to over haul your gearbox and for it to breakdown 3 months later. At this point I would suspect the worse and say they done a bog ass job to take your cash and fob u off.

Take it ti small claims on the ground that an overhauk of a gearbox means full re conditioning of it and as such you expect it to last more than 3 months. It should be at least a year. You will 100℅ wwiin this case only if you actually go through with it. Is it a lot of hassle. Yes. Is it worth it. Hell yes.

Be nice to them and politely ask them to fix it and tekk them its unreasonable for me to have it fixed by you and then to have it fall apart 3 months later.

Thanks for the above, that is the approach I am going to take.

It says on the warranty card they gave me with the mileage, name, car etc etc. Underneath is written labour not being covered etc.

So will see what they put on the table.

OP, who is the warranty work with? The dealer or an independant warranty company? I am going to assume dealer as within three months I'd take it back to the dealer and require them to fix it at their cost (SOGA gives you six months protection for products purchased).

All work needed should be fully covered by the warranty.
