Not sure if any of you can help me but I have a bat s**t mental mother who is claiming she has crashed her car uninsured, a quick check with the DVLA revelaed the car was insured and her dates dont make sense on when she crahsed the car (I saw her driving around in it after the date she stated she had crashed it)

How can I prove if the car has been crashed or not?

Go and see the car for yourself the DVLA database is sometimes a bit slow she may not be insured if she has missed a payment.

Erm, if she has lost that much of her faculties, should she be driving at all?

Who is saying she was insured? Her? The police? Her insurance company?
What was the nature of the crash?
Is she mixing up "driving uninsured" and "can't claim for a scrape/crunch as it's only 3rd party cover"?

You would of thought not..
Checked via DVLA who said she was insured (checked on several occasions) I dont know who she is insured with. She seems to think she rolled the car but is apparently unscathed.
I would look at it but not sure where the car is!

when I phoned up my insurers*, they were able to tell me who my actual insurers were. You could try that trick (ring admaral, pretend to be your mum, find out from there who the actual insurer is)

  • turned out, it was last years insurers not this years

I repeat, she is bat s**t mental. I should also add a compulsive liar.
For examples sake, I saw her driving the car on the Friday then on Saturday she says she crashed it on Thursday.

I know I saw her driving it but hardly any good at court, I need proof the car is still intact and driveable!

Why do you mention court ?

Id rather not go into too many details but she is refusing to declare it as an assett as she claims she has crashed it.

Dont know where she is keeping the car, I have a suspicion but im sure id be liable for breaking and entering if I went to have a look!

Is anyone else confused?

OP - calm down and structure your thoughts a bit more. A timeline would help us.

e.g.

  • On Monday
  • On Tuesday
X has said....
Y has said...

I'm concerned/worried because...

Ahh. So the court are going after her for assets but she is claiming that her car is written off and uninsured so a total loss? Not sure how you can prove that it is still on the road.

Anyway, OP, if she's claiming she crashed it so it's not an asset of any value, then you simply need to ask her to provide a court with legally acceptable proof of this. Her insurers demand she must inform them of any accident, so if she had one, they will have a record of it. And she's hardly going to stand up in court and say she either a) was uninsured at the time, or b) is in knowing and wilful breach of her insurance contract.

In any case, I would assume a police check of the MID will be able to verify whether or not the car was insured between any dates you like.

His Dad might not be around? He hasn't even mentioned him.
