Sorry if this has already been posted but from October 2012, wheel-clamping will be illegal in England and Wales.

I've never been clamped but this news just makes me feel warm and fuzzy inside.

From October it will be an offence in England and Wales to clamp, tow or immobilise a vehicle without lawful authority



What constitutes lawful authority,Just the correct SIA licence or other criteria?

The article appears to be saying the VI component of the SIA will become void after October, judging by the fact you can only renew VI until then. Currently only those with SIA licences can do it anyway, clamping without one is already illegal.

I would presume by 'lawful authority' only the Police can do it, or something along those lines.

That is good...but....

Is the provision to make the registered keeper liable for all fines contained as well? If so it will mean an end to the contract law ignorance of fines frown

Some examples.

If you drive around with no insurance the police can clamp your car.

If you drive around with no tax a dvla enforcement officer can clamp your car.

If you don't pay your council tax and a bailiff levy's on it they can clamp your car.

If you live in London and get caught doing any motor offence a bailiff can clamp your car.

If after some sort of court battle you owe someone money a sheriff can clamp your car.

If you park in a private car park some tt with an sia licence cannot clamp your car.

Note I mean bailiff. Not debt collector. You need to be court certified by a judge to be a bailiff.
Also if you are a court certified bailiff you cannot clamp car if you're out collecting on debts for electricity bills or phone bills or credit cards or the like.
