I have a deposit on my car which I am selling. Buyer advised that he will be splitting the purchase with a mate who is a registered car trader and wants the car registered to them via the V5C/3 (yellow bit of the reg certificate).

Buyer said that he will come over on a tuesday to pick up the car.

The added complication is that I have a personal reg on the car which I'd like to retain.

I have looked at the yellow section of the V5C "Selling or transferring your vehicle to a motor trader, insurer or dismantler" and it states "the motor trader must also sign and date the declaration" and then the current registered owner must send it off to the DVLA.

My questions are:

1) Wouldn't an authorised signatory from the car trader company need to sign theV5C/3 before I can send it off?

2) Even if I go over to the local DVLA office and get the car re-registered with the original plate to retain my personal reg, I will have to wait several weeks before I receive the new V5c with the original reg before I can fill out the V5C/3 and post it off. Would handing the car over without that be legit? Is it risky?

Given he wishes to complete the deal on Tuesday, I am a little worried about the two concerns above.

Any advice anyone can give would be much appreciated.

The plate belongs to the car, not you, at this point in time. The error here is putting your car up for sale before removing the plate from it. You'll either need to delay the sale or trust them to not run off with the plate.

Sellers who don't bother to put the plate on retention prior to selling the car so they can save the 25 quid extra it costs to retain versus transferring to another car are a huge pain for buyers.

I believe the buyer is prepared to collect the car and trust me with sending the yellow form off after I receive the new v5c with the original number plate assigned back to the car. My questions are really about the legality given the yellow form appears to need a signature from then trader purchasing the vichle as well as the risk exposure for me given I will be handing over a car that is still registered in my name for a few weeks until I receive the updated v5c and can fill it out and send it to dvla

As the car is registered in my name if traffic offenses are committed, I would be liable for them? I won't have a leg to stand on given it would be my fault for not sending off the doc off in good time? Also does the bit where he wants me to transfer ownership to his mates car trades company as they hare going halfs on the car sound a bit dodgy?

No, the driver is liable. You won't be the owner, as you'll have a sales receipt. You will be the registered keeper though. If anything arrives just reply saying the car's sold and give them the new owners details. The receipt will back this up.

Thanks so the arrangement does not sound dodgy? Don't I have to return the tax disc to have the plate changed back? How will I do that if he has the car with the tax disc?

Sending off the yellow section does not register the car to them. It means it is held within the trade without a formal keeper.

Send that bit off and the car is nothing to do with you - wave good bye to your plate.

But seeing as the buyer is prepared to pick up the car and wait until I retain the plate before sending the yellow bit off hopefully means it should all be ok

You can send off a form V317 to retain the registration at the same time as you send off the V5, with the purchaser listed as the keeper and you as the Grantee.

I just bought a car where the seller wanted to retain his number and this method worked fine.

You keep the tax disc, but need to send off the MOT certificate.

You get a replacement MOT certificate with the new number, and a new tax disc with the new number - you are asked to destroy the tax old disc when you receive the new one.
