dealer sold me a car with outstanding finance
Discussion
I bought a used car a month ago. Two weeks later they went into administration. I got suspicious and did a full hpi check on the car and it turns out it has an existing finance agreement. I never knew dealer will commit such fraud.
Now should I contact finance company to ask about this or will that be drawing too much attention to myself ? Also I paid part of the payment by credit card , can i claim from credit card company according to section 75 ?
I am so stressed that finance company will take the car away and i will lose lot of money. please advice.

I can't answer your questions but I would suggest you call Citizens Advice - link here.

Are you 100% sure there is outstanding finance......info on hpi can often be innacurate/out of dateNow should I contact finance company to ask about this or will that be drawing too much attention to myself ? I had the same problem with A VW main dealer back in 2008! Call the finance company and ask what the outstanding is. I also feel for you and know the dealer in question myself.

Is it still a naming and shaming infringement when the company has gone into admin which is confirmed on their website by an appointed liquidator?

What finance is showing?
Finance Company: SANTANDER CONSUMER (UK) PLCContact number: xxxxxx
Agreement number: xxxxxx
Agreeement type: Conditional Sale
The date it shows as april 2012 which makes me think it is still outstanding
There is conflicting avice on the web. In some people's experience finance company can take the car away and others say as an innocent purchaser as i did not know anything about this at time of purchase , they will not pursue it.

Very often a finance agreement that has been settled can still show as outstanding on HPI.
On the HPI there should be the name of the finance company, an agreement number and a telephone number.
Call them (you dont need to say you own it, you might be interested in buying it) ask if they have any further interest in the vehicle. Assuming the agreement has been settled, ask them if they can email/fax confirmation of the same. Also inform them that it is still showing on HPI.
One more thing.......
Next time don't bother HPI'ing a car AFTER you have bought it.
I bought a used Audi a couple of years ago from a main dealer. The HPi certificate supplied with the car showed it was on finance, when I enquired about it, I was told it was the finance the dealer had taken out on the car when they bought it in.You may be lucky that yours is the same.

Don't know where you are as your profile doesn't say - there is a story on This Is Gloucestershire regarding the sudden closure of Jason Jones so it might be worth you having a read of it.Now should I contact finance company to ask about this or will that be drawing too much attention to myself ? As for the car - as I understand if there is outstanding finance on the car you don't own it. The car belongs to the finance company & they will want it back.
As the dealer has now gone out of business you have no recourse to him. You can lodge a claim for your loss with the administrator however from what I have read, & been able to find out from people 'in the know' around here, you have no hope of getting anything back.
What many people don't understand is why has a seemingly profitable business been put into administration due to the 'ill health' of The proprietor.
It is rumoured - & I stress rumoured - that a lot of money is owed to atoot of people. Time alone will tell whether or not that is true. It is however a shame that a well established business has gone for good.
I also know the dealer - until he closed down he had a very good reputation so I don't know if people are mischief making knowing that he cannot answer his detractors.

First thing is to call Santander and get the figure.
Then call Nick Stafford at Hazlewoods LLP for advice.

One of the comments says that most of the cars on his forecourt were on outstanding finance which he sold on to public . There must be a lot of people in the same situation as me.Read the comments and the article.

I looked at some cars he had at the start of the year - none had any outstanding finance. Just because 'someone in a newspaper article' says that many cars had outstanding finance doesn't mean that it is correct.
I do think that some people are mischief making. I don't have any connection with him apart from nearly being a customer & knowing some people who know him very well.
