llegally right, but morally wrong?

Scenario
approach to roundabout (three exits) two lanes.the LH lane is backed up due to the first exit (exit 1) being full and progress is slow.
The right hand lane is empty and i want to go straight ahead (exit 2)
so whilst i could go up and across, the highway code says 'not correct'
BUT if i did a circuit of the roundabout from the right hnd lane, i could exit (2) OK
somehow, it wouldn't feel right.
Any thoughts?
