Hit and run my fault?

I was in Morrisons car park just pulling out onto the main though fare when a small motorhome cut the corner as I saw him come towards me I pulled as far to the left as I could or he would have hit me head on, so he has hit my rear/side drivers side corner ripping my bumper off. I got out he got out I asked him for insurance details he got back in his car and drove off, I ran after him he hit traffic so I got in front asking him to stop he then drove his car into me then drove off down the wrong side of the road through the traffic lights on the wrong side. The police are involved but the insurance company are denying liability and my insurance are saying the best they might get is 50/50. I am gutted about this as I really was not in the wrong. What can I do?

Find out where he lives using licence plate. Then make your own decision on revenge mechanism.

Ask for CCTV from Morrisons, could be helpful to prove liability.

No CCTV I asked the manager but I have 5 witnesses ( independent )

Surely more can be done...this is so much more than knocking someones car and driving off, he tried to bloody run you over!!!

Insurance companies really do seem to do feck all to help sometimes.

(Speaking as someone who was involved in a 4 car shunt on 4th July and is still waiting for the owner of the van which caused it to actually report the accident to his insurance company)

I am so gutted as this guy should be in prison, it was in Paignton at 3.30 really busy area as zoo is on same entrance as Morrisons and as I said he drove through the lights on the wrong side of the road as myself and the witnesses said it was just by luck he did not have a serious head on.
I am fully comp so it's not about getting the car fixed its about the principle now why the hell should I pay up.

If he drove his car into you deliberately, and you can support that, make a complaint of criminal damage to the police. Under national crime recording rules they should record it as such. Then you may be able to get compensation in exchange for agreeing a caution, or at least something re his details to pursue yourself.

Yeah he did hit me, I remember looking down and thinking what a stupid thing I had done by getting in front as I was about to get crushed into the back of a jag, but luckily he pulled right to get away.

you need to wake up tomorrow and see if you have a sore knee or something from where he drove into you, go to the doctor about it
if they won't pay for you bumper they can pay for your injuries, which will probably be a lot more

Whats the cost of the repair to your car? If under £5k small claims court. £125 to register it & once delivered the third party has 7 days (days NOT working days) to accept or choose to defend, if they do neither, tough, you win & can then start legal action to reclaim monies (bailiffs etc). Check with your witnesses if they're prepared to go to court & say what they saw (couple of hours off work for them at most). TBH though I'm surprised he has insurance as it sounds like a to me driving a motorhome like that.

This is a good idea. Once you win then even if you don't actually get the money then the car will basically be 'wanted' and if he's ever pulled over it can come up on the system. Basically becomes a right ball ache for him.

Bottom line is that if someone does this, chase them down, force them to stop and get their keys. Its hard to think straight at the time though.

So how does he find out who this other driver is and his address to serve the court papers.

And how does the bad guy's car become "wanted"? The cops won't have it on a database because of a civil court action and they don't even seem to be very interested in the criminal element of his actions.

Will look into the small claims line but I think damage will be about 2k
