Is the PH smiley copyrited?

Friend of mine saw my new car for the first time today (RB5 for added PH post-manly-company directer-oxo tower'ness) and while taking a look around the back of the car, notices my PH smiley.
"Oh I've got one of them!" and shows me the rear of his car, where there is the worst attempt at a copy that I have ever seen! At first I genuinely thought it was a PH smiley as they are fairly similiar, but on closer inspection you do notice some key differences like the con-rods going the opposite way etc. I'll take a snap of them both tomorrow to compare.
So, is it copyrighted? Could you copyright such a thing?

It is, though there are quite often copies made & advertised on eBay. Then Mr G sends a strongly worded email! Ah ok then! Unfortunately my friend bought this one from a stall at the recent ploughing championships here in Ireland, so probably no way of tracing the manufacturer. Didn't stop my friend paying almost ten euro for it!

Could be a bit difficult for Garlick to track them down

I think there was a cd rom made that had the PH logo on it & some sticker makers don't realise they're flogging fakes?
