Had heard of this happening before, but always thought it was an urban legend

Why wouldn't the insurers pay out? (apart from using any excuse in the book!)

Seems a bit OTT for the services to cut the roof off.

Speculation I know but you have to presume they were sitting in the car normally, having walked into it, and then can move their jaws to say it hurts.

I'd have thought neck braces would have been sufficient to get them out.

"We can only apologise to Mrs Dunlop for the inconvenience of that."

Well that makes it all OK then!

This type of situation has been widely anecdotally commented on but this is the first time I've seen what appears to be evidential proof that it happens.

I have also heard that police forces have been instructed not to allow crash victims to sit/wait in patrol cars, for the same reason - again, anecdotal (to me at least).

I know of three, and there must be others.

This one satisfies both your points: http://www.flickr.com/photos/bluelightphotos/69472...
