Interesting, I use the M42 a lot at rush hour and when the red X is lit I have never seen anyone drive down the hard shoulder. I can see how the problem occurs when all 4 lanes are full and there is an RTC, in m,y experience low and medium, speed RTC's are pretty common on the variable speed part of the M42, but there are fewer than there were before the variable.

I work on that stretch every day. There are HUNDREDS that do it. (We tried to count once and had to give up). There are also plenty of RTCs. It just means they are now in a more precarious place then they once were. They do, and I recall a short stretch of something similar in Lincoln I think.Wouldn't work at motorway speeds though; an out-of-control vehicle flying over into oncoming traffic doing 70 would be carnage.
