Traveling in lane 3, I was following another car (a good distance in front) and he indicated left and started to pull in to lane 2.

At the same time a car in lane 1 indicates and pulls into lane 2. They nearly hit each other, but a the last minute both seemed to see each other and swerved back.

I have seen this a number of times, so I wondered who would be at fault?

realistically, the guy in lane 3 should be going faster, so should be aware that the car in lane 1 is there...

he should also see the reason for the car in lane 1 to wish to enter lane 2, and (assuming he indicated) him signalling to do so.

ie, the faster car has the visibility to see it coming.

Have you ever been on a motorway in rush hour?

yes, and you are aware undertaking is illegal?

Usually be the person in lane one as they won't have checked over their shoulder. Although it'll go 50/50.

If I'm over taking like that I'll wait until I'm past the traffic in lane one as well. Or at least out of their blind spot. If that's not possible I'll watch the car in lane one like a hawk.

If lane one traffic is approaching a slower moving vehicle I'll stay in lane three that bit longer.

Poor observation from both parties. 50/50 IMO.

I'd go for 50/50 too. They couldn't collide without both drivers screwing up.

Guy in L3 will have had the best view previously and the most chance to anticipate the other driver pulling out. Guy in L1 should have checked but even with a lifesaver it can still be hard to spot someone comming in from L3. I'd go 50-50.

I tend to be extremely paranoid about this these days after a couple of close calls, either pulling out from L1 if there's a lot of traffic in L3, and equally being avoiding pulling in from L3 into someone's blind spot, though that's not always possible at busy times.

I'd say 50/50 too, if either party looked properly then there would be no collision.
