Foreign insurance claim nightmare
Discussion
Two years ago someone drove into the back of me on a roundabout in Belgium. The car was only worth 2K and the impact damaged the rear panel behind the bumper and the spare wheel well, so it was a write off. I was only insured third party but I made a claim against the other driver using my legal cover. The other driver disputed my claim saying I pulled onto the roundabout in front of them and then slammed my brakes on. This is complete and utter rubbish. The other driver was following me onto the roundabout. However, there were no witnesses and it was his word against mine. I was advised by the legal company there was nothing they could do and the best option would be to settle for a 50/50 split. This I agreed to on the basis that the other driver hadn’t made a claim against me. The foreign insurer agreed to the 50/50 split. For the past 18 months the legal company has unsuccessfully been chasing the foreign insurer for payment. They have been using every delaying tactic in the book. Today they have come back to me to advise that the other driver now wants to make a claim against me – two years after the event.
So where do I stand on this? If I have agreed to a 50/50 split does that leave me open to paying his claim (via my insurance) or can I dispute his claim? If I dispute his claim do I endanger the 50/50 split I agreed to on my claim? I have already lost 50% of the value of the car through the 50/50 split and then they knocked another £200 off for the salvage. So the claim is already down to £800. If he makes a claim against me and I can’t dispute it because I have agreed to a 50/50 settlement then the likely increase in insurance premium and loss of no claims bonus will reduce the net value of my claim even further. Why do I get the feeling I have been royally shafted?
