Does block exemption apply to used car warranties?

My father-in-law purchased an approved used Mercedes about 8 months ago. It is just outside it's manufacturers warranty, but still covered by the Mercedes approved used warranty (or so I thought). A my suggestion the car has recently had a routine service at an independent Mercedes specialist. They use Mecedes parts and can update the electronic Mercedes service record.
During the service the Indy spotted a split CV joint boot. They suggested this ought to be a warranty claim, particularly given the age and mileage of the car. So, the car was duly booked in at a main dealer, who suggested this would be a straight forward warranty job. However, on dropping the car off, they did an about face. They said because the car had been serviced outside the dealer network the warranty was void and he work would have to be paid for in full. My father in law promptly had a heated discussion and left without having the car repaired.
Now I admit to feeling a bit guilty and responsible, as it was my idea to use the Indy in the first place.
So, can Mercedes demand the car have a main dealer history? Doesn't blck exemption cover this? Surely the service history is irrelevant in this case anyway, as a CV boot is not a service item anyway.

Whether or not it's a service item is irrelevant, if you break the terms of the warranty cover ceases.
Put it this way. It may be covered.
But if it's marginal. "IF" it's not covered by the warranty. You would have been far more likely to get Merc to pay some form of goodwill towards it IF you had your car serviced with them recently. You've shown them no loyalty. Why should they be expected to show you any?

I'm not questioning whether it's a warranty item or not. If it falls outside then that's fair enough. The information I have is that this would be a waranty item. I'm just looking at whether they ought to honour that warranty or not."IF" it's not covered by the warranty. Unfortunately, the non main dealer service is recorded on the Mercedes electronic service record, so it's plain to see for any dealer. That'll teach me to give advice!You're buggered.

Try a different franchised Mercedes dealer. From a completely different group.
I believe they pay a subscription for access. As well as updating it, they can see all work previously done.Genuinely puzzled by that.
