eBay question

I am after a second opinion so to speak. I recently sold a used item on eBay, in the item description I put "I have NO WAY of testing it and therefore I am selling it as UNTESTED" and in the item specifics I put returns not accepted. I priced it dirt cheap as I genuinely had no idea if it worked.

Someone brought it, but now have contacted saying it doesn't work, did I test it? I replied with what the add says. And they have come back with they want to return it then.

What is the right thing to do here?

Taking into account it was sold as untested, clearly says that in the description, item specifics says no returns accepted, and priced it dirt cheap as I has no idea if it worked

Had similar issues and the Buyer did not raise a complaint. If they had I would expect EBay just to fall over and give out a refund.

Argue profusely but politely but be prepared to get turned over by ebay.

I will not sell broken or damaged items now better to just bin them.

I have replied to all the buyers messages in a firm but polite manner, pointing out that it clearly says untested in the description and under item specifics it says no returns accepted.

He should have read the description before he committed to buying, if he is stupid enough to buy something without reading it, then that's his problem and I don't feel I should refund him a penny.

I did not knowingly sell a faulty item, I had no idea if it worked, hence why I stressed in the description its untested and why I priced at least 200% cheaper than the others.

I don't feel he should be refunded.

Whether eBay feel the same is yet to be found out.
He has gone quiet for now, but I am expecting an email from eBay or the dreaded negative feed back, there goes my 100% positive rating.

Maybe he will even turn up at my door with a bunch of dodgy mates, who knows.

Suppose I just have to sit tight and see what happens.

As long as it stated in the listing clearly that it did not work you should be ok, be interested to know the outcome though if they open a case.
Had a simiilar situation some years ago and ebay actually sided with me, the seller for a change!

How do you have your returns policy set?

...and, if not much money involved is it worth the hassle to argue?

If you listed it as for spare parts or not working under item specifics they can't return it because it's not working

Even eBay can't dispute that , if you get a neg appeal it, I got one removed after I got threatened with a neg if I didn't refund because he hadn't received it

I'd only sent it 2nd class because it was low value so had to refund him, however he'd done it a few times to other people as well so I reported him and eBay closed his account

I did not know it didn't work, neither did I 100% know it worked. It was for a xenon ballast, I sold
It buy it now for £20, others are going for £60+, as I wasn't 100% certain it worked and had no way of testing it I put it up for £20.

However in the description I clearly put I have no way of testing it and I am selling it untested for that reason. Whether that makes a difference I don't know.

If it kicks off I will have to just refund the £20 and be done with it.

If you did buy it now the buyer has the right to send it back. If you do buy it now ALWAYS tick the returns accepted box & specify buyer pays freight. (because, in fact, returns not accepted might scare a few away, but is not valid for a buy it now)

Auctions are not subject to the distance selling rules

I decided to contact the buyer last night as a matter of goodwill, I offered to refund the £20 if the item was returned.

But as of yet no further contact from the buyer. And eBay have not got involved.....yet.

So I don't really know what's going on. Maybe he is planning a visit with a few mates........
