Tesla data tracking

As we have seen with the New York Times debacle, Tesla can get a huge amount of data back on what one of their cars is doing.

I write for a tech site and quoted Elon Musk “Tesla data logging is only turned on with explicit written permission from customers, but after Top Gear BS, we always keep it on for media.”. This comes from a tweet.

Does anyone know what form that "explicit written permission" takes? Is it a separate agreement which makes it clear what they are doing, or is it buried in a bunch of other stuff most people scroll to the end of and sign anyway?

The tweet says they have to explicitly ask for it to be turned ON, so presumably the customer has to ask for it, perhaps if they're having range issues and need Tesla to investigate?

Or just if they're the sort of person who wants to help Tesla develop the car further. I'd imagine quite a lot of early-adopter types would.
