On Saturday afternoon I put a deposit on a used BMW 3 Coupe from a main dealer, and signed order form. The car is in Blackpool, and I am in Newcastle so dealer rang to see if car was available, which they were told it was. So put deposit down and signed on condition that if car is expected, I will buy. Dealer has rang this morning to say car has been sold. The Newcastle dealer have another car in stock but it is 2k more expensive and 1 year older. Now where do I stand in terms of signing for a car which wasnt available?

I guess these things can happen when the car isn't on site. Chances are a guy was in the showroom buying it at the moment you were signing for it. Unfortunately he got there first.

Get your money back and carry on looking.

If I was female i'd say something like "These things happen for a reason". But i'm not, so I won't.

You get your deposit refunded immediately and carry on looking for a car.

You deserve compensation. BMW will give you a brand new car for free. rolleyes

Back in the real world, I'd keep on looking.

Is the 2k dearer car any better? Surely a deal could be struck seeings as they have your deposit and are risking losing a sale (end of month targets etc).

Otherwise money back & keep on looking.

Have a look at the local car and try to haggle if you like otherwise get your deposit back and look elsewhere.

^ this. Try and engineer a better deal on the other car - assuming you want it. With BMWs I tend to favour a post-facelift/LCI model as they are generally better with technical issues ironed out. However, newest does not always equal best value for money - buy on condition!

Obviously get your money back asap, but use this experience as leverage when you do find the vehicle you want at BMW, and negotiate something "for the inconvenience caused"

This sounds a plan but unfortunately I've learned there is little wiggle room with BMW's AUC scheme. Also even though they both trade as BMW Newcastle will likely be uninterested in making a deal because Blackpool are losing the sale. It's just not joined up like that (again IME).

Of course there's room for negotiation in BMW's AUC scheme!!

For example:

Late last summer, I bought an AUC 6 series from a BMW dealer about 100 miles from me. It was advertised at 14.5K. We shook hands at 12.1k.

About 4 years ago, my wife bought an AUC 5 series from a local dealer. It was advertised at 22.5k. She agreed the deal at 19.8k.

It all come down to negotiation at the end of the day.

Good stuff. I'd like to hear more stories like this for my own sanity! Also dunno if it makes a difference but the ones I've enquired about have been nearly new ex-demos.

I've always found that after the prepping/fixing/replacing etc. the dealers have to do to get to 'AUC standard' that there was literally nothing left and they'd happily let me leave with no phonecalls, conversations with the manager etc. frown

I bought a BMW approved car that was stickered up at 17K, would have been realistically priced at 15K and did the deal for 13750. They will deal if there's money in it for them.

I would use it as leverage.

A couple of years ago I was buying for a business purchase a Mini One D it was a pre-registered car with a decent spec and about £4k off the list from a main dealer. It was to a spec the lady in question wanted but was in the dealers network at another garage.

It was being paid for as a cash purchase so the funds went over straight away. I get a call about 4 hours later, oh sorry the car is a petrol not a diesel someone has screwed up.

The only option they had for me was a new one which was in stock but unregistered queue a debate about them wanting to sell it me for the list price.

I simply said don't worry about it you send me the funds back over I will get another one elsewhere. Low and behold they agreed the new one at the price I had paid as they really did want to give me the money back once the sale was in their sights.

Ask the dealer what would have happened if, say, you'd just taken out insurance for the year and found your insurer wouldn't cover you on the new car?

If they have to give money back and undo a sale they look like idiots.
It also gets flagged on a report at head office.

They can alter the car and terms of a customer without a problem, but if they lose a customer they get a big red cross.

I paid the deposit to take the car off sale and get it moved to Newcastle for a look. I signed order form to say if car is as described the balance would be sorted.

After a day of phone calls, they knocked £1980 off the dearer car, which is a nicer spec imo, and has my preferable oyster colour leather so has turned out ok in the end. Didnt look at that car originally as it was out of my price range.

Happy in the end!
