Im currently having a heated debate with a mate and need some answers lol. Can someone correct me (google / bing searches failed) but if someone who had a car park ding, no one injured but damage was light scratches gave the 3rd party cash to fix to avoid insurance, then 3 weeks later that 3rd party tries claiming off their insurance will that make their insurance claim void because of the duration?

I have been saying all along they don't have a leg to stand on, my friend says the complete opposite.

(this happened to someone we know)

If you mean "do insurers always enforce that clause that says accidents/incidents must be reported within n hours/days?", then no, they don't. If your pal can come up with a convincing reason why he's so late claiming, he might get paid out.
Of course if it becomes clear that he's claiming fraudulently, he might have the Police round, too (if he is).

If you've got some sort of record that the third party accepted the payment in full and final settlement then you're probably right.

The attempted claim is fraudulent, whether made with or without a delay.

However, when push comes to shove it's all a question of "proof".
