what are my rights if any?!
Discussion
went in to a dealer cause i needed a car asap as i had to start a new job which required a commute.
walk around and see a 1996, 406, 1.9td, 140k, 11 months MOT price... £500
i buy the car on account it has just been serviced and has service history, dealer says the service book is at the other dealership and i can come and collect it next week.
...come bk next week still no service book. week after no service book. THERE IS NO SERVICE BOOK.
driving along aux belt goes, i think its also got caught up in the cam belt cause know the revs are everywhere and so is black smoke. on top of that when im getting it towed the exhaust falls off cause its rusted through.
THATS LESS THAN A MONTH IV HAD IT.
what are my options and rights in this situation can anyone help?? thanks if you can

18 year old car, one bad day away from a scrapyard.
Wear and tear on both the exhaust and the belt - did you seriously not hear any noises before the belt went OR the exhaust blowing out??
Cant see the dealer being interested OR there be any realistic grounds to pursue through the courts.
As a mate of mine here in belfast once said of selling a cheapie car that broke down later "its like the titanic mate - it was alright when it left here".

£500
I think that should pretty much answer any questions. It had an MOT when you bought it, if you were that bothered about a service book on a £500 car you shouldn't have taken the car without it (really service on a £500 banger means absolutely squat TBH)The Aux belt is a consumable item, it letting go is just 'the way it is', the exhaust, it just fell off? Wear and tear anyway.
You have rights under the Sales of Goods act, that the car be fit for purpose, I'd argue that a £500 almost 20 year old car that's been over halfway to the moon giving you a months service is pretty decent, especially as you could scrap it for £250, cash the tax in and walk away with most of your money back.
It was an 18 year old £500 car. Sadly, these things do happen and you'll just have to put it down to experience.
Though part of me wonders if you still have a copy of the advert stating the car had service history, could you possibly get some money back for this? What did the dealer say to you? Tough luck?

yes but he lied to me. i wouldnt have bought the car if it didnt have service history.
Pursuing this would be a waste of your effort, time and money. Even though he should not have lied to you. The best you can do is tell the dealer what happened and see if you can get any kind of refund? He doesn't have to give you anything and will probably frown at the idea as the car was £500.I'd just make sure you see the service history before buying next time, the amount of dealers who claim FSH then "lose" it is unreal.
A service book wouldn't have made it any more reliable. The exhaust would still be falling off and the belts would still be end of life. A service book at most would give you some sense of belief that the filters and oil has been changed, because as a car reaches its older years nobody bothers with the full blown service.

Really? You wouldn't have bought an 18 year old car with 140k for £500 if it didn't have a service book?
The service book is misleading in this instance imo.
The OP said the vehicle had just been serviced, presumably by the seller.
If so, I (as a mechanic) would not expect the auxiliary belt to snap or the exhaust to fall off so soon afterwards.
A 'service' is not just an oil & filter change. Both the items that failed should have been inspected as part of the service and either rectified or noted down as needing attention, the dealer should (in an ideal world of course) have pointed this out to the OP when he was buying the car.
The purchase price of the car is kind of irrelevant if it has literally just been checked over and obivous things like these are missed/ignored.

And if it had been serviced, but no service record supplied with the car, you can't expect anything not to break IMO.
I have bought cars at £500 before, if they blow up 20 mins down the road, you suck it up and get on with life. Your 'rights' are literally nothing in this respect as the law is very vague about what your 'rights' are, and if you even took this to court, they would likely say 'It's a £500, 18 year old car with 140,000 miles on it' and that would be that.
IANAL etc etc etc.
