BMW 125d problems 50 miles after purchase.

I have seen a similar thread to this, but posted back in 2010 so was looking for more up to date advice.
The below happened over about a 5 week period.
I recently purchased a 62 plate 125d from BMW Westerly in Exeter, 27k miles on the clock, car purchased in cash, so no BMW finance to worry about; deposit was paid on credit card.
On the first drive home an engine warning light came on, in amber, "drive train problem, full power not available, please contact service". However, there did not appear to be any perceivable loss in power. As you can imagine I was a little annoyed.
Anyway I took the car back, they had a look, turned out it was a turbo con rod, took them a week to get the parts, all the while I had a free courtesy car, and they told me it was fixed. The glove box also has a very annoying rattle at A road cursing speed I asked them to look at, which they said they did but on return was still pretty noisy.
The day after I got the car back the same engine warning light shone brightly from the LCD display, rang them back, booked it in etc. had to wait for two weeks for it to go back, 15th of Sept.
So on Friday had to drive it, light no longer on, but surprise, surprise, it came back on 15/20 miles in; this time went in to ‘limp’ mode, lost maybe 30-40% of the power. So I called BMW assist, they took the car off and I now have a rental.
So what would you do?
Ask for an exchange? Ask for an extended warranty, Ask for money back...?
So far the actual service has been very good; BMW assist picked my car up and had a brand new 320d on my drive that evening.
Has anyone else had any difficulty with a 125d?

You can't legally until 3 attempts to repair the same fault have been made. I'd ask to speak to the general manager and see what he has to say. You may be given an extended warranty, you may not.
I would urge you to be calm and don't threaten legal action unless you mean it. BMW won't want bad pr so don't stress to much.
You've got to give them a fair chance to rectify the problem. So personally i wouldn't be looking to reject just yet. It seems the service you have had has been good so hopefully they will get it fixed this time.
P.S What is a turbo con-rod? A turbo problem is relatively minor a con-rod problem certainly isn't.

Rejecting a car needn't be a fight all the time. Go back to dealer, politely explain that you appreciate the help but the inconvenience of having the car fixed every 50 miles is too much and you want a refund/exchange. You've returned it three times now, ask them what they would do if they were in your position? They would reject the car too.

My difficulty is I have spent quite a lot of money, for me, on a car that I will be doing around 20k miles a year on. Problems 50 miles in do not bode well. The sales man who sold it to me, again being very helpful, is speaking to his manager and seeing whats what, I just want to make sure I make the right decision now, as I am going to have to live with it for another 3 years!
I should regardless push for a warranty though, as at the very least a gesture of good will? Also, regarding they need 3 attempts to fix the same problem; I would be interest to know the source of this rule?

Normally with BMW (In my experience) they will try and fix the problem, and anything else associated with it, as long as it's under warranty.
Mine had about 6k worth of work put through under warranty a few years ago on a problem which they could've done on the cheap - but they went the whole hog.

As you said, from the sounds of it, the service hasn't been too bad; more of just being a dud car.
I'd speak to one of their senior managers on site and see if there is something they can do, be it exchange it for a similar speck car (although I don't think there will be many 125d's). Westerley have five BMW dealerships so might have something similar.
It's not like this has happened 2 months after ownership, this is immediate.

Sale of Goods Act. It doesn't specify "three attempts" - it specifies that goods need to be of merchantable quality, with regard to their age/cost etc, and that the retailer has the right to reasonable attempts to repair before you can request a replacement or refund.TooMany2cvs said:

I've worked at enough dealerships for long enough to know what the law will allow.
There are two ways of tackling this, the hard ball way or the diplomatic way, option b will be much easier.
Also, regarding the sales of goods act, if you actually take the time to read it not just quote from the first page on the google link you clicked, you will see entire sections dedicated to cars.
Ive seen people coming in now and then saying they know there rights blah blah, it's like a script which always has the same out come.

There's umpty-ump pages of interpretation and analysis and conjecture - some of it might even be right.
Quick update to those who are interested; it was a fault Turbo, something to do with a recirculation valve, they are replacing under warranty.
Still waiting to hear back what they might suggest in the form of compensation, they have not actually offered anything, just that I should write a letter to the general manager, I was hoping they would as a matter of course.
