Hi
This is my first time on here and am hoping for advice.
In 2012 a car hit the side of mine on a roundabout, (he was in the wrong lane to come off and obviously thought I was a figment of his imagination and could drive through me to come off). I let my insurance deal with it, every phone call from his insurers was met with " My insurance company is dealing with this please contact them" . He admitted liability and my car was written off and I was given over £2000 (more than my car was worth).
Last week I received a letter from a solicitor telling me that this man is now making a claim against me for personal injuries and saying I was negligent??
I have been in touch with my broker who has been in touch with my insurers, who I assumed would tell his solicitor to go take a hike! As they should have all of this on record. But low and behold I have now received a form from my insurers asking me for details of the accident?? The same details I gave in 2012 ?
Has anyone else had this ? Can anyone tell me what to expect? This is stressing me out to the point I am having constant headaches and cannot sleep for worry.

It's just "business as usual", ie pass the letter from his solicitors (and it will be a "no win no fee" outfit, I'll wager wink ) to your insurers for them to deal with (as you did last year) smile .

Don't deal with his insurers or anyone else, just your insurers.

But OP is dealing with his insurer as he has been asked for details of the accident from his insurer, after it has supposedly been dealt with?

So he is asking why this is happening and for advice!

Two possibilities.

1. The insurer hasn't appreciated that it's part of the same incident.

2. The information they have is on the basis of a no fault claim against the third party, not on a claim against their insured for personal injury, so they need a different 'file'.

Did you pass it to your current insurer, or the one you had back in '12 and who dealt with the previous claim?

Ten to one he's just going with one of the cold call scam pondlife, and this hasn't gone anywhere near his insurer from that time.

How could the other driver even submit a claim if the original claim went 100% against him?

Back In 2010 my car was hit while parked, but i saw it happen. Her insurers sorted it and that was that.

Still some 4 years on I get a call per month (two in the same day last week) asking about the injuries I received, and if I wanted to claim.

You'll get those whether you had a claim or not. My old man gets 'em, and he hasn't even had a car for near-on a decade.

In the late '90s my cousin had a very similar accident which was ruled in his favour. A couple of years later an identical claim came through.

As a result of bewilderment (this stuff was rarer then) somehow that claim went against him. He feels it was because he was a new driver with a middle-aged woman claiming against him and also his lack of knowledge to do anything about it.

So do try to be proactive with your insurer, Op.
