Let's say a promentant sports car trader took in a non branded stock for PX, therefore not selling on their forecort and offloading through the trade, can Joe public bid or buy the px'd car themselves?
Or are the dealers obliged to only sell on pxs through trade?

They can sell it to you, but not as a 'trade' deal as you are not 'trade'

If they elected to sell it to you, you would be a retail customer and get all and any legal rights as if you were buying any car from anywhere.

If they want to sell it 'trade' they have to sell it to 'trade' and not a MOTP. Or they can send it to auction, if you buy it there you don't get any of the legal protection as you didnt buy it directly from the dealer.

HTH.

Thanks.
Is this common though and would many dealers entertain the idea?

Most (reputable) dealers will just say no.

If they are retailing it, it wil have prep, warranty etc.

No dealer will sell a car 'trade' to any MOTP as they're basically opening themselves up to get f'd in the A with the first problem and someone shouting about their SOGA 'rights' and for what? No profit, getting rid of a PX they could have just sent to auction instead!

And no amount of 'sold as seen' on a receipt will make any difference!

What about 'spares or repair'?

Very grey area and is still avoided like the plague by most dealers.

If made perfectly clear and they person buying the car collects with a trailer etc knowing full well what they are buying I believe it can be done, but all it would take is for the buyer to have a bigger issue than they expected and they come back for 'compensation' from the dealer and it all blows up in the dealers face.

A solid zero tolerance policy is best adopted by dealers IMO. Trade is trade, retail is retail. Simples.

You only need to read some of the PH tales of "dealer sold me a car cheap (as trade) and now I want to sue them" to realise why a dealer would not want to do this.

Yup.

Not worth the hassle.

Joe Punter will sit like a nodding dog when you tell him "no warranty implied or given, you're buying the car as it sits at this price, etc, etc" and a month later when an engine management light comes on he'll be back reading the riot act armed with "his rights" and threatening to go to "trading standards"

Try https://m.auction.sytner.co.uk/Home.aspx?UseMobile...

That's where the Sytner group auction off their px's

We have to be honest with the description too, as you have the right to return it if not as described, unlike eBay etc
