I sold one of my cars today, it was to a part time seller, so filled out the trader section of the V5 which I will send off to the DVLA.

There is around 5 months tax left on the car, how do I go about claiming a refund?

Or will the DVLA send me a cheque after I send my part of the V5 to them?

The trader thinks as I bought the tax before the regs changed, he gets to keep the tax?

Can anyone help, as I can't find the relevant info?

Cheers

as i understand it if it had a paper tax disc then its sent off the same way as it was, if its 5 months electronic tax you should get the refund automatically from DVLA (assuming they now know their ar5e from their elbow)

edit, just re read your 1st post, you said you bought the tax before it changed so paper version i guess, if its gone with the car you have lost it, you needed to send the tax disc back to get the refund

Nope. Paper disc is worthless since 01 Oct. See www.gov.uk/government/news/vehicle-tax-changes

There's a video which explains the new rules.

This.

He is breaking the law using the car if he does not re-tax the car himself.

No difference between 'electronic' and 'paper disc' tax. You sell car, automatically issued refund upon returning the V5. Buyer's responsibility to go online and tax the car before using it, even if it is still showing as 'taxed' by the previous owner.

Car tax is not transferred to the new owner under any circumstances.

What do you mean by 'using'? If it's for demos etc then surely trade plates negate the requirement for the car to have it's own tax? Or has that changed too?

There is around 5 months tax left on the car, how do I go about claiming a refund? A - There is a form you can get from the PO.

Or will the DVLA send me a cheque after I send my part of the V5 to them? A - The DVLA 'Claim' that refunds are automatic when you send in the V5C, however I have yet to hear of this happening for anyone I have asked.

The trader thinks as I bought the tax before the regs changed, he gets to keep the tax? A - No, he doesn't. Regardless of when the car was taxed, it is no longer transferable. As a trader, he should know this or he is pulling a fast one.

Shouldn`t this professional have grasped the details of these changes already?

Great, so as soon as I send my bit of the V5 back the DVLA will send me a refund?
That is actually quite a good system if it works...

I got the impression, he was planning on keeping it himself for a while, hence wanting it taxed

No that has not changed, but as he is a 'part time seller' I would assume he runs around in the cars he buys. So if he is using that tax disc, he is doing so illegally. If he is using trade plates and his insurance covers him for domestic use on trade plates then he is legal (most only cover use on trade played for demonstration purposes)

The only way that would work is if the date of sale is noted as before 1st Oct.

If he wants to use it himself as a runaround he needs to register and tax it. If he keeps it offroad and only uses it for demos etc then he can use trade plates when he takes it out on the road.

My understanding is that trade plates are for trade use only. Personal use is forbidden I.e. illegal. How likely it is that he would be caught is something else entirely.

He can do whatever he likes with the disc itself; since the changes its only use is ornamental (as you noted earlier)

I sold a car to a guy who fancied himself as a trader, I explained that the road tax would be refunded to me, and if he planned on driving it he needed to put it in his own name rather than trade. He didn't have a clue what I was on about.

He's been driving it around, even re-advertised it and stated it has 3 months tax on it (the same tax i've been refunded for).

I have to say, the DVLA have handled this change horrifically. It's not clear at all. I'm not sure how they think someone with no interest in cars will have a grasp of this.

Lot of car ads on here with many months of tax remaining being used as a sales point!

I'm assuming they don't give a st as they can just fine anyone who doesn't have tax and get their cash that way...

Use of trade plates for non MT purposes is a DVLA problem treated in the same way as not taxing your car if caught - any insurance issue is completely seperate and usually not an issue ( my MT policy states I can drive any car in my possession for MT/SDP as well as any car wearing the trade plate number xxxxx for MT but this does not change my legal obligation to not evade car tax)

Trader in the op's case is an innit trying to act as though the law doesn't apply to him - someone has perpetuated the rumour amongst those types that a disc on the screen isn't affected by the new law.
