I visited a friend at the weekend and the next door neighbour of my friend is trying to suggest that they saw me drive into their parked car when I left- which is just not the case!!! I'm so worried I don't know what to do!

We had someone drive into the back of us over a week ago, so we have rear drivers side bumper damage and a bit of the drivers rear side which is currently being dealt with by our insurance company. It's very cut and dry and it's all going ahead fine with the repairs having been authorised by the insurance.

It feels like they have seen our damaged car parked outside their property and are trying to use this to substantiate their own claim with their insurance? But do people actually do this?!!! It's keeping me up at night.

I've had to report them to the police for being threatening towards me and I haven't told my partner of their threats otherwise I think I would be calling the police for a very different reason if he found out.

I don't know what to do and it's making me so nervous.

It was dark when I got to my friends and dark when I left, so I didn't notice any existing damage to their car and why would I even look?, they are saying they saw me do it and heard a scrape and came Out to confront me- but it's a tiny narrow bit of road which required a 56-point turn (think Austin powers in the airport luggage carrier) so I wasn't going anywhere fast and it's just all lies!!

I feel like I did the right thing reporting them to the police, and I'm glad my original claim is still with the insurance before this, so there is an obvious administrative trail, but it just seems crazy.

Could be opportunistic, could have happened and you not notice. Either way, I doubt they'll get very far.

How did they get hold of you?

Surely with no CCTV or independent witnesses it's just your word against his and it will get nowhere?

If it didn't happen, can't you demonstrate that there is no damage to your car?

The neighbours went to my friends and all the other neighbours asking for details of people on their road that night/ visitors etc. All really strange. I said I was happy for my friend to pass on my mob to confirm what I was driving/ when I left- just so they could discount me. I feel like a right idiot now.

I mean though and isn't it possible to demonstrate it's not from this accident?

So they're blaming you based on the fact that no one else owned up to driving on that road that night??

If your car is being dealt with via an insurance claim then has it not had the estimates done on it already?
If so simply cross reference the damage to prove it was done prior to the neighbours accusations.

Unless there is an exchange of paint on the panels they are fishing for a free repair.
Tell them you will report them for insurance fraud if they continue to harass you into a claim.

Yea but the previous incident is already with the insurer: photos etc and there is no additional damage whatsoever- my partner would definitely notice if I did additional damage to his pride and joy! It was bad enough when someone went into the back of us and I was driving!

That's a good idea, yes we have already had estimates, and authorisation for repair.

It sounds like they are saying they saw you do it and confronted you but you and your friend are saying they didn't as they had to ask around on the street? So they didn't see you. Contradicting themselves already it seems.

I just find it hard to believe people are that sly.
I'm worried I'm going to have the police at my door, them at my door threatening me and a hefty insurance claim against me.
I feel like if people can get away with just lying so blatantly potentially, it's really scary.

Without witnesses or CCTV you have nothing to worry about. Inform the police of their accusation and forget all about it.

They are walking on very thin ice if they threaten you.
You have evidence that your car was already in process of repair.
As above they say they saw you but also went round the houses.

The only thing that I would do now, if they contact you again, inform them that your car was already in the hands of your insurance before their made up complain and that you have reported their threats and will also report attempted Insurance Fraud.

Stop worrying as you have done nothing wrong.

OP what car was it you're accused of damaging? This sounds oddly similar to something I'm reading on another forum albeit that thread is coming at it from a different angle.......

Mollie,

Without wanting to go all CSI on you:
- as other posters have pointed out, you had reported your previous knock to your insurers, so assuming your car has no additional damage (and your nearest and dearest seems to police that possibility quite closely!), then tough;
- does the damage these people allege tally in any way with where the existing knock on your car is/how/where you were parked in relation to their vehicle;
- what is the damage to their vehicle - are there any paint scrapes on their vehicle from this "other car"?
- on what basis are they alleging that you did it?
- absent CCTV/reliable eyewitness evidence, it looks like a civil claim, which will be judged "on the balance of probabilities";
- what is the amount of money they are claiming? - how does that stack up against their likely insurance premium for their car and the £750 limit for small claims court?
- have they asked for your insurance details? - if so, ask for theirs as you "want to make sure it's all dealt with through official channels"?
- if you're certain they are full of the stuff that makes the flowers grow, say so and that you're concerned they are trying to involve you in an improper claim and before replying to them formally, you want to check the position with trading standards/the Police.

Link?

I have no idea, It looked like a saloon. It was dark and I had no reason to pay attention to their car. We drive a new TT if that helps?

Just an alternative viewpoint - I've been sat in a stationary car in a car park that's been hit by a manoeuvring car. The 3rd party was in the process of driving away. When confronted they were absolutely adamant they'd not done the damage and it took the intervention of independent witnesses to convince that they most certainly had. Not everyone who has their car damaged is a scam artist.
