Hi everyone...

I've been looking around the internet for some help and found this site... there's a lot of results on google from here so I thought I would be a good place to ask...

The other week, I had a crash where I was hit by another driver, he was completely at fault as he came straight onto the roundabout without stopping, I have multiple witnesses to prove it, one of them even had one of those in car camera things and has offered my the video. Everyone stopped, details exchanged la-de-la-de-la... all good ...

I have duly notified my insurance company and said I have this video as well and they have taken the car away, already assessed the damage and have approved the repairs and I assume they will claim from the other party's insurers for the costs.

Today, 10 days later, I was looking over my documentation and found that my MOT expired 3 days prior to the crash.... For the record, the car was fully serviced the previous week by an MOT authorised garage and I would like to believe that if there was anything that they would have said... they did replace the anti-roll bar and front tyre so they did a good service.

Now, I haven't actually notified my insurers yet... I thought the first thing they would do would be to check the national computers for such... I even had a conference call with them and the DVLA to ensure I had a licence.

So, what do I do... do I come clean with my insurers and hope they understand or to I just keep quiet and hope they don't actually need to verify the MOT...

Really scared of what's going to happen as this is my first ever crash (in 20+ years) and its gone wrong big time....

PLEASE HELP!!!

BTW: as a new user, apparently I am not allowed to post in the Speed Plod Law bit for 14 days, but I need advice NOW...

If the other party is a fault you are still entitled to be compensated.

I feel for you as it's easy to miss an MOT renewal as it's not sent to you like tax.

Think this article covers it.

I'd sit tight and hope it doesn't come up and if it does be honest and say you didn't realise it had run out.

Most Insurers will be unconcerned. You'll read plenty of tosh about having no cover if the car has no MoT. Welcome to the internet.

Don't sweat it. Despite what other less informed people may say, your insurance is still valid despite you not having an MOT.

The only way it will matter is if your vehicle is written off. The lack of an MOT might negatively affect it's value. Hopefully not by much if it's just been serviced and in roadworthy condition.

Has the third party admitted liability? If so, try and approach their own insurers to deal with your claim?

Car not written off.... Damage begin repaired at a cost of about £2,300 on a £3,500 car - Actually surprised at that myself..

No, they denied it .. and I have since had a letter from his legal team saying they will be seeking full cost recovery... I have forwarded to my advisors

You were already on the roundabout and he entered and hit you, and he thinks he is not at fault?

Yeah... fooking idiot... but I guess that insurers tell you never to admit liability...

Make sure you have details of the other witnesses and grab the dashcam footage from the other car too. It'll help you in your case to prove liability.

Already sent the video off to my insurers... Bloody good quality too... I am most definitely going to buy one of these now. You can even see the whites of the other guys eyes as he braced for impact.

In that case I'd sit back and wait for the letter from the other party's legal representatives saying they're retracting their claim...

Prefer not to right now... rather wait for the insurance process to complete first.

Did the police attend? was the accident reported to the police, and have they asked for documentation???

The police were notified but as there was no obstruction on the highway, no injuries and all parties stopped, they said let the insurance companies sort it out.

They don't actually tell you this when you've had an own fault bump and they are dealing with you x

I was in the same situation, but it was 17 years ago if that makes any difference (I doubt it though).

My car was a write-off and the Insurance company paid me out, no bother.

I've never checked whether any of my customers cars had an MOT, nor a third party. My only concern is if their at fault or not.

I have however heard of other insurers declining cover. Not mentioning names however.
