I had an accident back in May last year which is still being processed and I was wondering if you travel on a 20mph road pretty busy and there is a physically smaller side road 20 mph as well is that called a junction ? Because that's what the other parties insurance have told me and because of it I might have some % of fault In that accident...

Sorry that not in the right place for this forum but I still have the 14 days restriction.

Where the side road joins the main road; that's a junction.

As part of a 20mph scheme some local authorities are removing junction markings, the idea being that if no-one knows who has priority everyone has to stop and decide for themselves. Unfortunately many roads already have worn out junction markings where priority used to be to whoever uses the main road and so this priority is still operated by those using the road.
The difficulty is for road users new to a junction who dont know what everyone else knows
No wonder accident rates in 20mph schemes seem to increase.

Its not all about priority. If you see someone hasnt seen your there and is about to pull straight out of a road junction, although you have priority its still a good idea to give way if it prevents a collision

What happened?

Were you on the side road?

As saaby points out, if the road markings aren't there then it might be ambiguous in a 20mph zone (though I assume they still have to be marked in the usual way?)

And who is removing road markings?

I was undertaking (filtering) a que of cars and a Taxi was turning right from the opposite lane and completely got in my way... I know I could have been more careful but so did he anyway it will probably be 20/80 in my favour, which isn't bad but it WIll affect my insurance premium when I want to get a car in few months time.

Forgot to add I was on a scooter.

I know what you mean. You were undertaking a queue of cars approaching the junction. A car coming in the opposite direction was turning right into that junction. He failed to keep a proper lookout and didn't see you as he turned across your path into the junction.

The thing is, there is plenty of case law on these scenarios. If, as the scooter rider, you failed to reduce your speed as you filtered and passed the junction, you are very likely to bear some percentage of the blame for the damage. The trick is to filter more slowly.

Do you mean a junction where you can go right left or straight ? I'm talking about a little side road which I thought wasn't a junction... In that case I have to filter at 5mph everywhere because there is always that little side road .

Yes, that little road is a junction. People will pull across queuing traffic both in and out of it. If you're on a scooter, many will not see you (doesn't matter if they're right or wrong for that, just accept they won't). That's why every time you approach a side road and you're filtering, slow right down.

I mean, I'm sorry, they're your bones and head- don't you want to preserve them FFS (apologies, but you're not going to last long unless you learn)?

Of course. Heres one.

There's been some discusssion about it away from here
Increase in 20mph casualties 20%, yet there was a reduction in all other built up roads
It's happened for a number of years

Yeah, I guess you're right... I do accept the fact that it is hard for people in cars to see a little scooter behind traffic (especially today after I drove a car for the first time and realised how many blind spots they have) I was just curious about that little road being a junction. Now I know Cheers

Out of interest you mentioned 20mph in your opening post
Do you think you or anyone else would have behaved differently if it was 30mph?

It might be the wine but I think I need pictures, I think I understand it then I read the next bit and am more confused than before!

Do insurance do 20/80? I thought it was just all, nothing or 50/50.
