Purchased a car from a main dealer over Christmas, got it home, inspected and it's got some issues (DSG)

Warranty has been turned down due to something not being done when it should have been.

Been offered a refund, but here lies my problem. I traded in a BMW 123d, nice condition etc. now in order to get my car back or of similar spec / age / condition I have got to pay out £2k.

Where do I stand with this as I feel I'm in a lose or lose situation.

The issue for the dealer is if the car is repaired it'll have to be at their expense, which ironically is more than the £2k PX loss.

Car never went through the 143 check system correctly from what we've worked out.

Trying to understand the boundaries before I re-engaged..

The main warranty may be void if it has missed a check in the past, however, the dealer who sold you the vehicle has the responsibility to repair the vehicle. So you aren't going to loose out on any money.

He also has three chances to find and repair the same fault, so don't think its that easy to go rejecting it either.

They have offered a refund after the manufacturer customer care dealt with the case. So going to start to head down this route

Nope sold to another garage and I'll have to pay the difference if I want it..

PX + finance is how the car was purchased. I was hassled down the finance route, but had planned to pay it off in full within the first month or two as there is cash in the bank. The finance will be cancelled too as the car and finance are linked if I'm correct. Via Black Horse.

So my car was PX for £8.5k and it's now up for £10.5k with all others in same bracket at £10.5k

I'm on the verge of finding a £500 tin and waiting for 1st March to see what trade ins are coming, plus have a rethink over it all.

Lost total faith in the dealer as they've also have an exchange, but why would you take another car from a dealer that failed from day 1

Just because your old car is being sold for 2k more than you bought it for doesn't mean it will sell for that, you also need to add in sales preparation costs then sales fee's, being a car dealer isn't a charity.

If they've offered a refund bite their hand off, you accepted the trade in so the dealer shouldn't have to give you any more money.

Crap situation and I've been there, difference is I had to trade the car in and lost £700, so to come out even is a result in a short amount of time.

OK will probably go down the route and wait till March 1st to see what comes on to the market and of course never venture near any of this dealers franchises again.

The brand customer care team will be speaking to me again later today.

Gutted to be frank and ruined what was a good Christmas.

Will be serving them a nice 1 star review on their facebook page and other sites they have.

Sir, please refer to my response to the OP with the head gasket failure on their Polo.
I am sorry to say that if you deal with a main dealer you deserve everything that happens to you. They have NO interest in you as a customer whatsoever. You are a means for them to maintain their OTT image that they KNOW works on all the thicko people that insist on dealing with them.
A sad fact of life is that there are very few manufacturers main dealers that care anything about the human beings that walk in through their doors. They are only interested in the bag/pocket kept at your waste height that usually has the means to flush as much as possible of it away from your grasp. 50 years in the motor trade has taught me this.

Bloody hell, that's harsh.

OP, I was wondering, what is the issue and was there any sign of a problem on a test drive? Or is it something that only came up on an extended drive once you bought the car (my wife had a golf which developed a gearbox fault after 3 years ownership which would only rear its ugly head after at elast 20 minutes of driving, far to long for a mechanic to be driving around to try and replicate the fault! it did eventualy st itself so it got fixed)

If you can take the refund, do so. Maybe you can explore some other cars, why go back to your old car (I understand you trust it though)? There's a whole motoring world out there!

Really?

I am not that far behind you time wise, and whilst the above may be true for some dealers, it is certainly not a catch all statement.,

I've stated that I want full refund + £2k to VW UK and will see what is said. Trading Standards indicate I have a valid reason, so fingers crossed.

It may be easier for the dealer to get you another "new" car

You where happy to trade your car in against a VW (for £8.5k) - So I would have thought as long as the dealership finds you another car of similar value and spec (and confirms it's a good one) - then you will be in the same situation before the fault occurred.

Not suggesting you turn down the refund, just saying a new car (same value, spec better condition) might be a better outcome all round.

I think that is a tad unnecessary.

Ultimately whilst the used car has gone wrong (it's a car sometimes they break) they are offering you a refund.

1 star IMO goes to the cowboy traders who when you require some warranty item or something fixing they tell you to foxtrot Oscar.

I also would not want to damage my chances of acting in a reasonable manner and achieving a decent outcome. You may get the extra money you desire from VW although so long as you get the purchase price back for the car you have bought I really don't see the big issue.

Cars do go wrong sometimes and it really is not always someone's fault.

No review will be left until the final outcome, if it all goes well then yes things can change. VW UK have been helpful thus far as they have their own questions now with the dealership in question.
