I went to look at a car last Tuesday that I was interested in buying. After looking at the car and test driving it I was quite happy to put a deposit down and agreed to collect the car up on the Saturday (31st Jan)

Went down on Saturday and had a look over car before I paid the full sum of money. There was a dent and big scuff marks on the rear of the car which I didnt see on the Tuesday. I told them I didn't want the car in this condition which was fine. They said they'd repair it in body workshop but even still I didnt want to do business with them. The sales manager was cheeky to me when he found out he wouldnt be getting the money.

I received a phonecall from the garage on Monday there. They taxed the car before I arrived on Saturday so I am now the registered owner of the vehichle even though it has never been my car. I will be getting the V5 registration document. Im guessing they cant sell the car again unless I sign the section in V5 that I am no longer the owner. I am basically asking what do I do from here? The garage say I need to get the V5 to them as soon as I get it and to sign section 9 in the V5. But the DVLA say I must return the V5 to them straight away with a letter to say I never took ownership of the vehichle and that it has been returned to trade.

Uh, why did they send it off? Did you sign it?

No such thing as a "registered owner". The V5 does not show who owns the car, only who is the registered keeper.

If the garage were taxing the vehicle for you as part of your purchase, they would have been to the post office with the V5 and a cheque to tax the vehicle for you, placing you as the registered keeper of the vehicle, so that you don't loose the tax immediately as it transfers keepers. Luxury of this new tax system the DVLA are insisting on.

If the vehicle is repaired to the standard it was when you first viewed the vehicle (im guessing it happened since) then why are you not happy to continue with the purchase? If the dent was there at your viewing, and you didnt notice, but they are happy to repair, surely that could be seen as a gesture of goodwill?

The dent wasn't the only problem. There was no spare key either. They said they would sene the key in the post. A bit unsafe if you'd ask me if the key went missing. I was just p*ssed off with their whole attitude. Never going to buy another car from this particular dealer again. Too many bad stories about them. You could easily guess what dealership it is.

Ive sent many a spare in the post, often when waiting for customers who have px'd to drop them in, not had issues. But there you go.

Oh, dodgy dealer? What made you go there in the first place?

Well I've learned my lesson now. At least the dealer is going to give me my deposit back once we get this V5 sorted out

Each time I've bought an Approved Used car it's happened like this and I always wonder what would happen if I didn't want the car. I always agree a price and leave a deposit prior to viewing as I am usually very far from the dealer. The agreement is always that if I don't like the car the deposit is refundable. On each occasion I've liked the car and gone through with the deal but they've ALWAYS already sent the V5 off when I get there. It seems a bit weird really.

Sounds like he was looking at the wrong car. Was it also a different make/model/colour as well or maybe playing at Stevie Wonder for the duration..

You've obviously never dealt with the great British public then?

If buying a car from a dealer, rather than privately, the focus on the first visit is surely 'Do I like the car? Do I want the car? Do I like the condition of the car? Can we do a deal? Does it drive ok?' not 'does it have a radio code? Is there 3 keys?'. Thats handover stuff and it's assumed this stuff is present.

The whole point in buying retail not private is because it's 'safer' - the dealer adds value to the process by preparing the car to a decent standard, making sure the spare key isn't lost, blah blah.

Rib him for not noticing the dent instead, that's a schoolboy error that one is hehe

Op - do you think it was more a case of buyers remorse? Ive done that quute a few times; made a decision abd put down a deposit only to foll around in bed all night thinking that it was a bad move. Ive sometimes lost a deposit but accepted it.

If they give you your money back after going through the rigmarole of deregistering it then they cant be that bad.

Do you yhink that if you really wanted the car then you might have bad the repair and key in the post?

The car was damaged between me putting the deposit down and going to collect the car. They say they cannot take a trade in unless your car has two keys yet they cannot provide a spare key for your new car on the day.

They lost the sale because of poor customer service and the manager being a cheeky ****. I would've happily got the car repaired had their customer service been to a decent standard.

He said there would be two keys provided on the Tuesday. Saturday he says there's actually no spare key for it.
