She had an accident in October 2016 where she was sat in traffic and someone coming the other way turned right behind her and took out the side of his car on her rear quarter. He was foreign and got quite irate so she called the police. They turned up and calmed him down enough to swap details etc.

She passed it to her insurance and they fixed her car and she then put it from her mind. A few weeks ago they called as apparently he's claiming she reversed as he was turning and it's all her fault.

Obviously this is bks and she told them so but the solicitor has called back today and is asking her to sign a form to say she accepts 50/50 as this is the result she expects at court. She's been told that she doesn't have to sign but the decision will then be with the insurance company and they'll just say it's 50/50 anyway (if his insurance even accepts the 50/50 offer)

Massive kick in the tits because some can't drive properly. Tempted to put on my PH goatee and pop down to PC world (where he works) tomorrow and dominate the till by hammering frozen sausages into his eyes.

Where it was, shes the red car.

The junction, she was over the island in a Toyota Aygo so hardly covering the world.

Damage to hers

Damage to his

The tt being spoken to by the police

Those foreign people driving around in non-private hire UK-registered vehicles. All such a nuisance.

Also perhaps tell your missus not to block a junction and then reverse back when she panics. The scratch marks on the alloy quite clearly show it wasn't rotating at the time of movement, otherwise it'd be a lot more circumferential.
(edit: alloy on the BMW, the marks on the BMW's tyre align too)

Half an hour for a prick to turn up. Not too bad.

Funny how he only realised she had reversed a year later and not at the scene.

Given that both cars have moved from the incident to the photos your detective skills need some work. A huge junction like that works fine with an aygo in the middle.

why not? The insurance company data states the postcodes in and around these areas are known for crash for cash

The map saying Newark on it may be a hint to the location and it doesn't seem like a crash for cash accident in any way.

Admittedly it requires a bit of effort but have you tried reading the OP's post?

Insurance companies pressuring clients into 50/50 when said client disagrees was the topic on you & yours yesterday (R4).

Apparently it's on the increase. Stick to your guns OP, hope it goes in your favour.

Did the police make a report and take any statements? I would hope that the lawyer has asked but you never know.

Stick to your guns and fight all the way. Sick to the teeth of the innocent paying for the guilty. Ombudsman if need be......

We had a car at work which was queuing to leave a car park. Another car reversed out of a parking space into the side of our stationary car. The insurance companies agreed 50/50! They really can't be bothered.

Agreed, stick to your guns. It might be a bit extra hassle but I'd say 100% not your wife's fault. Even if she was blocking the junction (which it appears she wasn't) that's no excuse for st driving by the BMW driver.

No witnesses.
One person says X.
One person says Y.

Who's to be believed, and how do you prove that person's the one who's not lying?

Yes, fair enough. But it's quite hard to get a door stoved in without someone driving into you.

The reversing car was moving, the other car dived in behind 'em. Who's to blame now?

Why would it even be the OP's wife's fault *if* she did reverse? The third party was crossing the carriageway, therefore the onus is surely on him to ensure it was safe to do so.

To the OP - as above, stick to your guns.

Even if she were reversing, is it not the responsibility of the other driver to give way to traffic in the lane they are crossing?
