So had sp30 15 months ago and forgot to tell insurance, so last week 35k motor stolen outside house, the insurers are sending my claim to underwriters for review, what’s likely to happen?

They’ll either pay, or they won’t. I guess.

Unless they would have declined you cover on the basis of the SP30, in which case you’ve had it, all that normally happens here is that they ask for the extra premium they would have charged had they known, plus admin.

would their knowing about those points either:
- loaded the premium more
- meant that they would not have insured you

If the first then they are likely to charge you the excess in that premium
If the second they may tell you that you are uninsured - as well as a scenario where the points would have meant not insuring you, do they have a clause saying that non-declaration will invalidate your policy - if so, then they may refuse to insure you...

outside those two fairly different possibilities, it shouldn't affect the claim per se as those points have no material relevance to the incident being claimed...

so you could have:
- no issue - claim dealt with
- pay the excess premium - claim dealt with
- you are not insured, goodbye

there is precedence for all three approaches

There are only 2 reasons why they would refuse the claim.

1. They would not have insured you whatsoever had they known about the conviction (unlikely)
2. They conclude that you deliberately avoided telling them to get cheaper insurance (they are unlikely to reach that conclusion for a single speeding offence, and if they did, they'd have to justify it to the ombudsman if you escalated it).

Chances are you'll be ok.

How many points did you get on your licence for the SP30 you mention, and how many do you have total?

If you had a clean licence and got three points on it for speeding, it probably wouldn't make a big difference to your insurability, and thus to your position now.

OTOH if you're on 9 points and the insurer is only aware of 3 of those (or none), then you might be in a position where they wouldn't have insured you for the year had they known.

You own(ed) a "35K motor".

You "forgot to tell insurance" about an offence.

Yep this is key. Unlikely but not impossible they would only have insured you with no points but if you had six didn't tell them about the new three and that would have led to a decline, there may be trouble ahead.

There are a few possible outcomes depending on your circumstances but its hard to predict without knowing a lot more about your offence record, accident record, age, etc.

Did they ask about your licence when you claimed? I can’t recall it ever being queried.

If it gets sticky I suppose you could argue that your driving record isn’t material to a claim for theft. Although maybe your diligence / honesty is.

That isn't relevant.

Only 2 things matter (as per the insurance act 2015). Would they have insured you had they known the truth? If no, you're stuffed. Can they demonstrate, on the balance of probability, the non disclosure was deliberate. If yes, you're stuffed. That's it.

I did caveat my comment but you chose to omit that.

I was thinking more of the Ombudsman’s opinion, if it got that far. They can be pretty random but do tend to err on the side of common sense.

Even the ombudsman wouldn't take that into account. For non disclosure, it just doesn't matter if the claim was completely unrelated to the non disclosure.

For a straightforward theft from outside a house, will they even bother to request OPs driving license details?

Fair point - I had a humongous crash on the M62 seven years ago, I was taken off the motorway to a local taxi rank (was near home) by HATOs literally minutes after. Was home about 30 minutes after the (single vehicle) crash so never saw a copper or the carnage/traffic jam I’d created. Rang insurance. Car written off, paid out 8 days later. Never filled in a single form, (clean) driving licence not asked for etc etc.

It may depend on whether or not you're insured by one of those companies that look for a way to avoid paying out.

I'd be wary of relying on experiences from some time ago, though - things change.

This post is missing vital detail: yes the motor was 35k, but what is the current market value of the house it was stolen outside of?

Compo face picture of you pointing at an empty driveway or it didn't happen.

But in seriousness, hope you can get it resolved.

As alluded above, do you have any other points on your licence other than the SP30 you forgot to declare?

Is the car worth £35k, or is that your assessment?
