So long story short, my 190e was 20 Miles away at a yard waiting for some work. Just after Christmas someone sends me a link of it up for sale so I go into panic mode.
Can't find any sign of the person it was with that agreed to do the work and the guy advertising it says they are a waste management company that work with the council and give me the details of the council guy involved.
He says they found the car abandoned on a road and couldn't trace the owner? So it was lawfully sold to the company?
Now the car was and is still insures and we had all the documentation and the main keys.
Dvla said they would investigate and so did the police.
A week later its back up for sale!!!

Lots has happened since but want some opinions on what others would do in this situation.

Arrange a viewing & then collect it with back up / mates as you have the keys assuming they still fit?.

I've no idea what you're asking pal.

Is the car insured, what did your insurance company say?

What did the 'yard' owner say?

What did the garage say who you dropped the car off with to have this 'work' done?

Which Council?

What planet?

I'm smelling a windup mate, but hey ho.

My best answer is:

At least you haven't got to worry about having the work done now.

I informed the police I was going to get it after the second advert, I went to the yard and drove it home.

6 guys from the yard turned up at my house 3 hours later trying to get it, called the police and they said "they have documents that say they ate entitled to the car as it was seized for no tax"

If we didn't know the car was dumped on a road how can we have reported it stolen before?

Anyway the police searched our house and gave the guys the keys while threatening to arrest me but couldn't take the car as it was blocked in.

Under no circumstances would they have given them the keys - this has to be a wind up surely

My best answer is:

Insurance company just said they were going to pay out as stolen and recover the car.

The guy doing the work has disappeared off the face of the planet, phone number doesn't work and I've been to where I dropped it and there is nothing there.

I dont want to give the councils name just yet because it seems this guy on the council is stealing classic cars "lagitimatly"

Yes it sounds like a wind up to everybody because its such a stupid thing.

I wish but when a Councillor or calling the shots they just go on that.

Dvla are doing a full investigation as they have told us the car shouldt even exist let alone me be able to drive ot home as the company put a certificate of destruction on it weeks ago along with changing the log book before that.
They got me to send pictures of the car now with all the chassis numbers ect.

Exactly when they told us they couldn't trace the owner but managed to trace us when we got the car back!

The legal responsibility of the council to try to contact the registered keeper (you) before disposing of the car seems to hinge on whether it had number plates on it at the time

https://www.gov.uk/guidance/abandoned-vehicles-cou...

If it still had the plates (or a tax disc - what's one of them in 2023?), the council is obliged to reach out to you via the DVLA and give you 7 days to collect the car.

If it didn't have the plates, they can apparently dispose of it immediately as they see fit, including selling it on to someone else.

Seems very much open to abuse to me, not to mention unnecessarily lax. Surely a query on the DVLA database by VIN would be no more onerous than one by registration number.

Remember, snitches get stitches. They snitched, which means you are both legally and morally entitled to sew up all the holes on their clothes. Pants, socks, trousers, peephole bras, if it has a hole you can stitch it up.

Maybe the "yard" has an upholsterer on site who can lend a hand? They're usually hot stuff with a sewing machine.

Councillors don't "call the shots" with the Police.
