My son was hit hard from behind on the M25 by an uninsured eastern European of no fixed abode driving a friend's shed.
His car was totalled, my son's electric MINI has significant damage to the rear but is just driveable. There was a witness happy to give a statement. The Highway Patrol or whatever attended and apparently fined the guy on the spot, but then my son (having been breathalysed etc) went home. He has genuine neck and back strains.
He has fully comprehensive insurance (£500 excess - wonder how that compares to the fine paid by the idiot that hit him) but how will this play out?
Any similar experiences and/or advice out there please?
Already Enterprise Hire Cars have said they won't be helping with a replacement car because there is no insurance company to bill it to..........

It should be treated like a normal insurance claim, where your insurer claims it all from the MIB.
As for the courtesy car, if your insurer promises onne or you paid extra for that option, you are entitled to one.
However, if it isnt included, when its a non fault claim, the other sides insurer sometimes provides it, in this circumstance I dont think the MIB do.

I think if you contact the mib they have a scheme which helps with this , or perhaps your sons insurance will be able to offer advice .
I hate the fact that you work really hard to afford nice cars etc and some scrote (polite version of what I call them )can drive uninsured and cause damage and walk away and they know it,
I suppose if you have the name and address of the driver involved and his mate you could claim against them.
I hope it works out for you.

I'm not sure what part of my first post that Mustang thinks is ....nonsense, but I can assure you that it is 100% what happened on Tuesday night near junction 3 of the M25. My son has a police incident number etc.
Thanks for information about the Motor Insurers' Bureau one and all, I didn't realise that such a body existed. I wonder, do Aviva approach them directly or whether the victim has to make a claim personally?

Just let your son's insurance company deal with it.
