Potholes are beyond a joke now - they are killing people. Or is the motorist or biker to blame?

I've driven that very stretch of road a few weeks ago, it and many others throughout the South are covered in potholes now.Telegraph said:

You spend time looking at the surface and dodging to avoid them if you can.
While I've been lucky to avoid breaking wheels, I've had to have 2 new windscreens in the last 6 months caused by stones from poor roads flying up. Last replacement windscreen before that maybe 10 years ago.
They don't even bother to wipe the roadsigns with a sponge to clean them, so the roads have no chance of being maintained.

king Top Gear Challenge. Still, VED's gone up so this should be a problem of the past now. 
Potholes reported to the county council on the approach to that farm, back in March, and that these had been visible for at least a month before

Once the Council is notified about a pothole, they are supposed to conduct an inspection "in a reasonable amount of time", and the inspector determine if it needs repair or not, and if an emergency repair is warrantied.

I hope the Police can find clear evidence that the presence of the pothole was the root cause of the incident and the Council gets prosecuted for manslaughter.
A rather silly suggestion. A council cannot be prosecuted for manslaughter nor can the government who have underfunded authorities or even the tax payers who clearly do not contribute enough to make the whole system function correctlyI hope the Police can find clear evidence that the presence of the pothole was the root cause of the incident and the Council gets prosecuted for manslaughter.
There is only one person responsible and unfortunately he has died.
Had the driver been travelling at an appropriate speed he would not have lost control and created so much damage. At least there were no other fatalities.
BTW Taxes including VED are not hypothecated.
Drive to the conditions? I've seen many cars swerve into oncoming traffic expecting them to move over, rather than stop or slow down when faced with potholes, cyclists, or whatever. I can't believe the driver is entirely blameless here. Not that they deserved to die of course, but actions have consequences, and sometimes luck runs out.
Chariot-spec wheels also don't help. Perhaps a bit more tyre and drivers wouldn't be so precious?

Don't know what the limit is, however it is a narrow road with clearly at least 1 house right on the edge of the road, it may be a 60 limit down there, doesn't mean you have to do 60 though.
