I’m being sued because Yoga have not paid the third party

I was in a bad smash 2023. Totally my fault. I exchanged details and contacted my insurers who were Yoga Insurance. Yoga paid out and I settled my finance on my car which was written off. Today February 3rd 2025 I have received a legal letter from my third party’s solicitors saying they are taking me to county court claiming £8427.18 damages. I have rang them asking why and they have said that Yoga have not settled with their client after all this time and that I should contact them. As all such matters are handled online with Yoga I have attempted to login to their portal with no joy. I have no way of contacting them. Now I am terrified that I am going to have to pay the claimant out of my own pocket. I don’t know what to do. I am worried sick. Can I have some advice please.

According to their website Yoga Insurance Services Limited is authorised and regulated by the FCA and their registered number is 786347.

That matches their details on the FCA register where it also lists their telephone number as 01302 565501. Call them first thing tomorrow.

It does sound drastic, but that is the way it works. You were at fault, so in the event of no settlement, the claimant's solicitors will come after you.
That's one of the reasons you have insurance.

So pass it to your insurers.

Despite what you say, there will be a way to contact your insurers. You must have contacted them previously, as they settled your claim. So contact them again, and pass the county court thing over to them to deal with.

As soon as I saw the address I thought One Call.

Same building, same owner, One Call are the claims handler for Yoga: "One Call Claims are the claims handling agent on behalf of Yoga, they are authorised by the Financial Conduct Authority and the Claims Management Regulator in respect of claims management services. Yoga has a number of insurers on its panel. Not all of those insurers use One Call Claims as their claims handling agent."

Basically a brand.

I contacted Yoga’s director and also spoke on live chat who both explained that they are just the broker and that I needed to contact Ageas who are the underwriters of my claim. I rang Ageas and they asked me to email them the paperwork from the claimants claim form which I have done. They have also instructed me not to fill it in and respond and they will take it from here. The lady on the phone said there is a lot of correspondence and that she does not know why the claimant has not been paid but hopefully the matter will get sorted. I’m still really worried but not as much as I was an hour ago.

Unfortunately this is pretty common. Give them a couple of days then keep reminding them until they sort it out, which I am sure they will.

Sounds like it’s being sorted but Yoga are not “ just a broker “ - you arranged Insurance via them with Ageas as the Insurer and at the very least they owe you a duty of care.
If you are still worried then email their complaints dept and cc Ageas.
