Looks like its a copyright issue which seems a bit draconian. I mean, I understand why the Italian authorities get sniffy on clones of their own products, but the Spanish police to do so seems a bit harsh.

Depends what country you're in.Some countries only protect the "name and badge" while others protect the "shape", a bit like copyright in a book or artwork.

Wether they can protect their design in a particular country is a different matter.

Murcia - The National Police have arrested a man in Elche for an alleged crime against industrial property after he put a vehicle up for sale that imitated a Ferrari. The investigation began after an online advertisement was found for a car resembling the 360 Spider model at a price far below the usual rate.
The agents, from the Cybercrime group of the Murcia Police Headquarters, verified that it was a replica built on the chassis of another brand, using fiberglass and low-cost materials, but illegally reproducing the design lines, logos and typography of the Italian firm.
The operation led to the vehicle being located in the El Altet area, where it was impounded. Despite having documentation compliant with traffic regulations, investigators concluded that the use of Ferrari identifying elements constituted a criminal offense.
The detainee is accused of infringing the brand's industrial property rights, in an action that highlights the police's increased vigilance against this type of fraud in the used car market.

I sold a Harley Davidson fabric iron-on patch online about 10 years ago, it was a cheapo one I didn’t know the origin of but sold it for a few pounds while having a clear out. I kid you not, Harley Davidson contacted me and threatened legal action!! Unbelievable really, over a patch. It must’ve cost them more money paying someone to write the letter than I’d have made if I sold 100 of the things.
