MOT Failure Rules...?

Hi all

MOT ran out today, so had myself a test today. The car failed (doh!) on some crappy things. But the result is that it's failed the test.

I asked the garage and they said I have 10 days to come back and get a re-test. During those 10 days, am I legally allowed to drive the car, or is it only to have the work done?

AFAIK you can only drive it to and from being fixed and having another MOT.

The 10 days is just for a reduced price re test of your vehicle. You are NOT allowed to drive during this period apart from going to and from a BOOKED mot appointment

You can drive it if the car is still MOT'd and is not dangerous to drive.

EG my non Elise car failed on Monday on an OSR wheel bearing. However, the car has 2 weeks MOT to run, and is not dangerous so I'm pretty sure I can drive around in it until my retest.

NO, if it has failoed an MOT, it is unroadworthy and con't be driven

Even for a wiper blade or defective rear seatbelt if no one sits in the back?

Yes, your old MOT is invalidated as soon as you fail another MOT. Sorry

If you have faulty seatbelts, take out the seats that correspond to that seatbelt and car can't fail.....

I could ask when I take my car in for its MOT on tuesday, but that would probably be a bit late. Of course, I might have to ask on my own behalf.

What about driving to somewhere for it to be fixed? I had to drive mine to a welding place last year after it failed on rust.

You leave it at VTS to be repaired or get it towed to repairers. I know that's not fair but them be the rules.

irked Hmm, I didn't know that. How come I was allowed to drive away (directly to the (tester recommended) welding place FWIW) if it is illegal to do so then? I'm not being funny here, just genuinely want to know how it all works.

Actually, you are wrong here.

Failing an MoT does NOT invalidate the previous certificate- You cannot revoke an MoT cert.

Whilst your car may be technically "unroadworthy" under the terms of what is inspected in the test, it doesn't mean you are driving without MoT so would not commit the offence.

However, it WILL show as a fail on the computerised record so AFAIK you could not tax it online.

In my understanding and i think the law. You are allowed to drive to and from a BOOKED mot. When you left the MOT and went straight to repairers, you had broke no laws. If you had gone home first, you would have broken the law. When you left repairers and went back to VTS for a BOOKED mot, you would not break the law. Hope that makes sense?
