Uninsured driver question

Quick question for the masses.
You hear a lot of horror stories of being crashed into by an uninsured driver, but how does it work the other way round. By which I mean you as an insured driver hits an uninsured driver.
I'm fortunate enough not have been crashed into so have no experience of going through the process of an insurance claim but I always thought the two drivers insurance companies would talk to each other and so sort it out that way. How does it work if the claimant/victim/other party isn't covered?
Would the insurance company deal directly the second driver? But then surely they would have something to say about the other party not being insured and so involve the police etc.

Being insured doesn't have a bearing on blame, if they put in a claim against you for vehicle damage or PI they will pay out, the police may issue them points for no insurance but doesn't mean ur not at fault. I've seem a few hit in rears where the non fault party was unlicenced/uninsured/drunk, doesn't mean it's there fault they got hit though
Surly an insurance company would have a case in court if they refused to pay out on the third party.
It is an accepted rule of all insurance that for their to be a claim the vehicle must be used in a legal fashion, so regardless of who's fault it was, the uninsured vehicle would forfit the protections provided by the insurer of the vehicle at fault.
I would be interested to see what would happen if an insurance company ended up in front of a bloke in a wig due to something like this.

You make a good point & although I may well be wrong I thought that only applied when claiming off your own insurance. A long time ago I bumped into the rear of a new (2002) Golf gti in my Transit - broke my numberplate but destroyed the bumper of his car.
Got out to exchange details and he said he wasnt insured as he spent all the money on the car! He asked for a few hundred quid to sort the damage and I refused, explained to him it was a works van and would rather do things right.
He got in a huff and then drove off - I rang the police to tell them what happened, they took my details and his reg and asked me to sweep the road clean.
Never heard anything else.

Help please if anyone can, i was on the other side of this claim however i was insured the person i let drive my car wasnt a very naive mistake and this is what happeend can anyone she dnay light on this situation and anything i could do please?
I think about 3years ago, i for some stupid reason allowed my boyfriend of that time to drive my car, however later understanding he was uninsured when the crash happened i was under an insurance company called Link insurance PLC and they said at tehy time they will fight the legal case and as it happened it was deemed the fault of my then boyffriendmy car was written off at the scene and i had to bare the costs of the the other drivers car who i feel had done a red light as i was the passenger damaged his right wheel arch by hitting a stationary vehicle as we were in the middle of a right turn junction he had two passengers the driver and one passenger claimed for whiplash, and even though we both paid the fines and recieved the points a year later the insurance company wrote to us asking to pay back £22,000 we started to pay them and it has been two years however this amount will take a considerably large time to pay and well i have been trying to ask for a breakdown of the claims and amoutns etc but have never recieved this instead have recieved or had threatening/accusationary phone conversations.

Your writing is difficult to understand. Try using punctuation.
I think you are saying that you let an uninsured person drive your car. There was an accident where a car was written off and there were personal injury claims.
Why should your then insurance company pay the cost when your driver was uninsured?
What has being a student got to do with it?

On a serious note, it looks like you let an uninsured driver use your car, he had a fault accident and your insurance company are looking to recovery their outlay from you. This is the correct course of action and unfortunately there is nothing you can do about it except pay (or be sued).

Sorry rohima300, but that's the only thing that matters.If you knew he wasn't insured, then the law is that you're responsible for what follows. If you didn't know, then you need to consider whether to sue your boyfriend for the money or not. Neither is a good position to be in.
