As I always thought, if you get clocked doing over 100 it's an instant ban.

Well ladies and gentleman, let me introduce you to 33-year-old Porsche Boxter driver David White who got caught doing 110 and got away with a fine.

His excuse: He was concerned when overtaking a foreign registerd lorry and then used the "I'll lose my job if I lose my license" line.

Most certainly not true. I have real life experience to back that up - as far as I am aware there is no automatic ban criteria.

Part of me thinks "fair play for getting away with it", the other part thinks "just cos he's got the money for a decent lawyer, why's that fair?"

118.5mph on the M4, 6 points & a £350 fine. Just because you are doing in excess of 100mph, doesn't automatically equal a ban. The Magistrates have a sliding scale for punishment.

I had no representation, just a well worded character witness statement, dressed smartly (you would be amazed how many people turn up in tracksuits & baseball caps) & was very apologetic to the Court. I went in expecting the worst (a ban) and was plesantly surprised. I do also think it depends very much on the judge.

My uncle is a Magistrate & told me he would have banned mehehe

You can get let off scot-free for triple figures if you happen to encounter a suitably understanding policeman and the driving conditions are appropriate. whistle

You answered your own question there I reckon. Perhaps they were merciful because they saw that you saw and by immediately lifting indicated that you knew you'd been naughty?

One of PH's resident lawyers said they advise people to turn up in a tracksuit and baseball cap because the judge assumes they are poor and gives them a lower fine. hehe

I have been let off for over 100 few years ago and I was young driving an escort GTI, I was phyiscaly shaking and I thought I was in for it.

Was asked how fast I was going, didnt really answer he said well we was going 95 when you overtook us and im supprised you couldnt see the light fittings in the back of the car.

He said he knows what its like to be young but doing speeds like that is just asking for it, gave me a talk shook his hand and have never driven that fast again - The system works!

Mate got done for 103mph and got £400 fine and 6 points too, was going considerably faster tae but Police marked down the speed as clear road good weather and very fast car!
We went by polis at at least 140mph they took a wee while to catch us up (we had to slow for a van a mile ahead that looked as if it was gonnae pull out).
Guys were quite interested in his car, they liked it a lot:lol:

Nope. At over 100mph, Magistrates are obliged to consider a ban, but it is not automatic. As others have said, prevailing weather and traffic conditions as well as the defendant's offending history will be taken in to account.

That's cleared it up for me - I always assumed unless you begged 100+ meant a ban!

I was summonsed at 105mph. Received 6 points and a £250 fine + costs. For the full story - use the search function from around March/April 2008.
